The undersigned is directed to refer to your letters cited above. The item-wise comments are as under:-

Necessary amendment in the IREC in the matter of inclusion of corrigendum issued under Board’s letter dated 08.12.2014 has been issued as per ACS No.130 (Board’s letter No.E(W)2014/FU-1 dated 18.01.2017 (Copy enclosed).

As regards the NFIR’s request for enhancing the allocations against three heads of scholarships covering educational/technical education, attention is drawn to Board’s letter No.E(W)2008/FU-1/2 dated 29.01.2009 vide which the SBF Committees have been empowered to invoke the provision to re-appropriate upto 25% amongst the different Heads/activities except “Education, Sprots & Scouts activities”.

The intention for fixing the ceiling limit of upto Grade Pay 4600/- for grant to financial assistance in distress and sickness etc was that such financial assistance should be available to lower Grade Pay Staff. Moreover, consequent to implementation of 7th CPC recommendations, there is a substantial increase in the salaries of staff including the staff in the Grade Pay of above Rs.4600/- and does not require further revision in the existing provision.

In view of above foregoing, NFIR’s request is not feasible for acceptance for the time being.

In exercise of the powers conferred by the proviso to Artical 309 of the Constitution, the President is pleased to direct that S.No.1 of Rule 805 of the Indian Railway, Establishment Code, Volume 1, 1985 Edition be amended as per enclosed Advance Correction Slip No.130. This amendment is effective from the date of instructions issued vide letter No.E(W)2014/FU-1/1 dated 30.07.2014.

This office is receiving several references from various controller offices seeking clarification regarding pay fixation under Seventh CPC in respect of “Trainee” appointed on compassionate ground without acquiring minimum educational qualification in the pay scale of Rs.4440/-  – 7440/- (Pre-revised) without any Grade Pay. Such trainees are to be placed in the pay Band-I (5200-20200) with Grade Pay of Rs.1800/- only on acquiring the minimum qualification prescribed under the recruitment rules. However, under the 7th CPC, neither any specific pay Matrix/Level not the manner for fixation of pay in respect of MTS Trainee has been prescribed.

2. In this regard, it is intimated that matter already stands referred to the Ministry for furnishing necessary clarification/guidelines to regulate the pay fixation of trainees under Seventh CPC. Reply of the same is still awaited. As and when, replly is received from the Ministry, the same will be widely publicized. Hence, it is requested to await for orders/clarification from the Ministry in the regard.

Subject:- Central Civil Services (Leave Travel Concession) Rules, 1988 — Fulfillment of procedural requirements – Clarification reg.

The undersigned is directed to refer to para 8 and 9 of the Guidelines enclosed in this Department’s O.M. of even number dated 18.2.2016 on the above noted subject and to say that the issues have been revisited. It has been decided that the cases where a Government servant travels on LTC upto the nearest airport/railway station/ bus terminal by authorized mode of transport and undertakes rest of the journey to the declared place of visit by private transport/ own arrangement (such as personal vehicle or private taxi etc.), may be dealt with as follows:-

(a) In all such cases the Government servant may be required to submit a declaration that he and the members of the family in respect of whom the claim is submitted have indeed travelled upto the declared place of visit.

(b) If a public transport is available in a particular area, the Government servant will be reimbursed the fare admissible for journey by otherwise entitled mode of public transport from the nearest airport/railway station/bus terminal to the declared place of visit by shortest direct route.

(c) In case, there is no public transport available in a particular stretch of journey, the Government servant may be reimbursed as per his entitlement for journey on transfer for a maximum limit of 100 Kms covered by the private/personal transport based on a self-certification from the Government servant. Beyond this, the expenditure shall be borne by the Government servant.

(d) Furnishing of false information will attract disciplinary action under the CCS(CCA) Rules, 1965.

Note: For the purpose of these rules, the expression ‘Public Transport” means all vehicles, including trains and airplanes operated by the Tourism Development Corporations in the Public Sector, State Transport Corporations and Transport services run by other Government or local bodies.

Dearness Allowance for Workmen and Officer Employees in banks for the months of February, March & April 2017 under X BPS/Joint Note dated 25.5.2015

The confirmed All India Average Consumer Price Index Nembers for Industrial Workerss (Base 1960=100) for the quarter ended December 2016 are as follows:-

October 2016 – 6345.60
November 2016 – 6322.77
December 2016 – 6277.12

The average CPI of the above is 6315 and accordingly the number of DA Slabs are 469 (6315-4440-1875/4=469 Slabs) The last quarterly Payment of DA was at 478 Slabs. Hence there is a decrease in DA slabs of 9, i.e.469 Slabs for payment of DA for the quarter February, March & April 2017.

In terms of clause 7 of the 10th Bipartite Settlement dated 25.05.2015 and clause 3 of the Joint Note dated 25.05.2015, the rate of Dearness Allowance payable to workmen and officer employees for the months of February, March & April 2017 shall be 46.90% of ‘Pay’. While arriving at dearness allowance payable, decimals from third place may please be ignored.

We advise banks to pay the difference between the old and revised salary and allowance to officers on an ad hoc basis, pending amendments to Officers’ Service Regulations.

Subject: Grant of Advances – Seventh Central Pay Commission recommendations – Amendment to rules on computer Advance to Railway Servants.

Consequent upon the decision taken by the Government on the recommendations of Seventh Central Pay Commission, the Ministry of Finance vide their [OM No.12(1)E.II(A)/2016 dated 07.10.2016 ##eye##] have amended the eligibility criteria in the existing provisions relating to the grant of personal Computer Advance.

2. Amendment conditions of grant of Computer Advance are as follows:

3. Further, Ministry of Finance in their ibid OM have also decided that the other interest bearing advances relating to Motor Car Advance and Motorcycle/Scooter/Moped Advance will stand discontinued.

4. The above mentioned OM of Ministry of Finance relating to grant of Interest bearing advances will apply mutatis – mutandis to Railway employees also.

4.1 So far as the interest free advances are concerned, Bicycle and warm clothing advances stands abolished for Railway employees also in terms of MoF’s decision.

4.2 Orders relating to other interest free advances will be issued separately separately by concerned Directorates.

5. Necessary/Advance Correction slip to the chapter XI of the Indian Railway Establishment Manual, Vol.I Revised Edition, 1989 will follow.

6. The revised orders are effective from 07.10.2016 i.e the date of the issue of the aforesaid OM of the Ministry of Finance. Past Cases where the advances have already been sanctioned under the provisions of earlier rules on the subject need not be reopened.

PART- A

GENERAL GUIDELINES

1. In supersession of all the guidelines governing admissions in Kendriya Vidyalayas that have been issued in the past, the following guidelines are issued to regulate admissions in the Kendriya Vidyalayas with effect from the academic session 2017-18.These guidelines are not applicable to Kendriya Vidyalayas located abroad.

2. DEFINITIONS

Unless the context suggests otherwise, the definition of the following terms used in these guidelines would be as below:-

(i) CENTRAL GOVERNMENT EMPLOYEES : An employee who draws his emoluments from the consolidated fund of India.

(ii) TRANSFERABLE : An employee who has been transferred at least once in the preceding 7 years shall be deemed to be transferable.

(iii) TRANSFER : An employee would be treated as transferred only if he/she has been transferred by the competent authority from one place/urban agglomeration to another place/urban agglomeration which is at a distance of at least 20 kms. and minimum period of stay at a place should be six months.

(iv) AUTONOMOUS BODIES / PUBLIC SECTOR UNDERTAKINGS Organizations which are fully financed by the government or where the government share is more than 51 per cent would be deemed to be autonomous bodies/ public sector undertakings.

(v) SINGLE GIRL CHILD: Single Girl Child means the only child i.e. only girl child to the parents, with no other siblings.

3. PRIORITIES IN ADMISSION

The following priorities shall be followed in granting admissions:-

(A) KENDRIYA VIDYALAYAS UNDER CIVIL/DEFENCE SECTOR:

1. Children of transferable and non-transferable Central government employees and children of ex- servicemen. This will also include children of Foreign National officials, who come on deputation or transfer to India on invitation by Govt. of India.

2. Children of transferable and non-transferable employees of Autonomous Bodies / Public Sector Undertaking/Institute of Higher Learning of the Government of India.

3. Children of transferable and non-transferable State Government employees.

4. Children of transferable and non-transferable employees of Autonomous Bodies/ Public Sector Undertakings/Institute of Higher Learning of the State Governments.

5. Children from any other category including the children of Foreign Nationals who are located in India due to their work or for any personal reasons. The children of Foreign Nationals would be considered only in case there are no Children of Indian Nationals wait listed for admission.

Note: Preference in Admission to wards will be based on the number of transfers of the parents in the last 7 years.

(B) KENDRIYA VIDYALAYAS UNDER PUBLIC SECTOR UNDERTAKINGS/ INSTITUTES OF HIGHER LEARNING:

Children and grandchildren of employees of the Project Sector/Institutes of Higher Learning which are the sponsors of the Vidyalaya,Children of Project employees & Post Graduate students who are working on long term research projects, Children of regular Council of Wardens (COW) employees and children and grand children of retired employees.

Note: Preference in Admission will be given to children of serving employees, grand children of serving employees and children and grand children of retired employees in that order.

2. Children of transferable and non-transferable Central government employees and children of ex- servicemen. This will also include children of Foreign National officials, who come on deputation or transfer to India on invitation by Govt. of India.

3. Children of transferable and non-transferable employees of Autonomous Bodies/Public Sector Undertaking/Institute of Higher Learning of the Government of India.

4. Children of transferable and non-transferable State Government employees.

5. Children of transferable and non-transferable employees of Autonomous Bodies/ Public Sector Undertakings/Institute of Higher Learning of the State Governments.

6. Children from any other category including the children of Foreign Nationals who are located in India due to their work or for any personal reasons. The Children of Foreign Nationals would be considered only in case there are no children of Indian Nationals wait listed for admission.

4. ELIGIBLE AGE FOR ADMISSION

A Child must be 5 years old as on 31st March in the academic year in which admission is sought for Class 1.(Child born on 1st April should also be considered.)

Note: The maximum age limit can be relaxed by two years in case of Differently abled children by the Principal.

B. There is no age restriction for admission to Class XI provided the student is seeking admission in the year of passing Class X examination. Similarly, there will be no upper& lower age limit for admission to class XII provided there has been no break in the continuous study of the student after passing class XI.

This provision is applicable only for those parents of cat I in civil & Defence sector and cat I & II in project & institutes of higher learning who have been transferred during the current session after the registration process is over. The admission will be Granted on First – Cum First serve basis immediately as and when parent approaches for admission in the vidyalaya.


6. RESERVATIONS IN ADMISSION

A. SCHEDULED CASTE AND SCHEDULED TRIBE CATEGORY

15% seats for Scheduled Caste and 7.5% seats for Scheduled Tribes shall be reserved in all fresh admissions in all Kendriya Vidyalayas

B. DIFFERENTLY ABLED CATEGORY

3% seats of total available seats for fresh admission will be horizontally reserved for Differently Abled-children as per the provisions of RTE Act, 2009 read in conjunction with Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995.

7. ADMISSION WITH KV TRANSFER CERTIFICATE INCLUDING LOCAL TRANSFER (TC).

(i) Admission of children with KV TC will be automatic (over and above Class strength) if the parent has been transferred from one station to another. When the class strength reaches 55, efforts should be initiated to open additional sections.

(ii) Defence personnel and Para-military Forces who shift their families to a station of their choice whenever they are transferred to some non-family areas or posted in Naxal affected areas, can admit their children on KV TC in a KV located at the station where they keep their family.

(iii) In all other cases where transfer of the parent is not involved, admission with KV TC would be done only with prior approval of the Deputy Commissioner of the region concerned.

(iv) All cases of local transfer on KV TC will be done with the approval of DC concerned on merit.

(v) A student with KV TC may also be permitted in project KVs only up to class strength of 45 with the prior concurrence of Chairman, VMC. Beyond this no admission on KV TC would be done in project schools. However, Deputy Commissioner of the region is empowered to allow admission in the project/nearest KV in extremely deserving cases.

8. EQUIVALENCE OF N.1.0.S I STATE BOARDS I ICSE FOR ADMISSION IN CLASS XI IN KENDRIYA VIDYALAYAS

The students of State Boards/ICSE/NIOS where marks are awarded be considered for admission in class XI if vacancies exist. The marks awarded in various subjects are considered against the corresponding Grade awarded by CBSE.

9. ADMISSION FOR CLASS X AND XII

Admissions to. class X & XII (other than KV students) will be entertained subject to availability of vacancies. Such admissions to class X and XII will be considered by the Deputy Commissioner of the Region concerned only if the average strength in class X/XII is below 40.This will further be subject to the following conditions:

i. The child has been in the same course of studies i.e. in a CBSE-affiliated school.

ii. For Class X, the child must have obtained not less than 6.5 CGPA in class IX (CGPA be calculated as per formula applied by CBSE in class X).

iii. For admission to class XII, 55% marks in class XI examination is mandatory.

iv. The child should otherwise be eligible as per KVS admission guidelines.

v. The combination of subjects opted by the student is available in Kendriya Vidyalayas.

10. ADMISSION OF CHILDREN STUDYING ABROAD

A KV Student, who accompanies his/her parents on their deputation to a foreign country will be admitted to corresponding class on their return to India in the Kendriya Vidyalaya, where admission is being sought (such admissions will be over and above the class strength)

11. ADMISSION FOR VACANT SEATS

In case seats remain vacant after 31st July in the year of admission, Deputy Commissioner of the Region is empowered to allow admission upto the prescribed strength as per priorities in admission upto 31st August.

Note: In case of any issue related to the interpretation of admission Guidelines, the decision of Commissioner KVS will be final.

PART- B
SPECIAL PROVISIONS

1. Following categories of children would be admitted over and above the class strength except where stated otherwise in the provision itself (e.g. Item No. XVI).

i. The children and dependent grandchildren of Hon’ble Members of Parliament.

ii. Children and grandchildren (children of son or I and daughter) of serving and retired KVS employees.

The Children and grandchildren of serving and retired employees of KVS (Kendriya Vidyalayas, Regional Offices, ZIETs and KVS (Hqrs.) will be considered for admission at any time of the year irrespective of the class strength/year of transfer/recruitment. However, for class IX, the child has to clear the admission test. (The wards of Officials/Officers who come on deputation to KVS also be treated at par with regular KVS employees).

iii. Children of Central Government employees who die in harness.

iv. Children of recipients of Paramveer Chakra, Mahavir Chakra, Veer Chakra, Ashok Chakra, Kirti Chakra &Shourya Chakra, Sena Medal(Army), NavSena Medal (Navy), VayuSena Medal (Air Force).

v. Children of recipients of President’s Police medal for gallantry & Police medal for gallantry.

vi. Meritorious sports children who have secured I, II & Ill position in SGFI/CBSE/National/State level games organized by the Government. vii. Recipients of Rashtrapati Puraskar in Scouts & Guides.

vii. Recipients of Rashtrapatipuraskar in scouts & Guides

viii. Single girl children in class I and from class VI onwards subject to a maximum of two per section in class I and two per class in class VI and onwards. It includes twin girl children also.

(a) In case of twin girls, it will be treated as one admission.

(b) While drawing the lot, name of both girls(twin) should be written on a single slip

(c) In case of single girl child (including twin girl children), if number of applications are more than the number of allotted seats i.e. maximum of 02 per section in class I and 02 per class in class VI onwards , the admission should be granted on the basis of priority category. If in one category more applications are made, all such applications should be taken together and the list of selected candidates should be prepared through draw of lots.

ix. Children who are recipients of National Bravery Award, or of Balshree Award instituted by National Bal Bhawan.

x. Children whose parent is a teacher, and is a recipient of National Award for teachers.

xi. Children who have shown special talent in Fine Arts and have been recognized at the National or State level.

xii. 100 children of employees of the Ministry of HRD would be admitted every year on orders issued by the KVS (HQ) up to 31st July.

xiii. 60 admissions in Kendriya Vidyalayas located anywhere in India and 15 admissions in hostels of Kendriya Vidyalayas, would be granted to employees of Ministry of External Affairs each year, by orders of KVS (HQ). These would be regulated as follows:-

a) 60 admissions in Kendriya Vidyalayas located anywhere in India be utilized exclusively for children returning from abroad along with their parents after their posting. Seats under this provision remaining unutilized at the time of normal admissions will remain as such and will be utilized for children who return to India after the beginning of the academic session and up to 30th September. Children who return to India after 30th September would be considered for admission up to 30th November. No special consideration will be given to MEA staff under this priority. All these admissions will be subject to the condition that not more than 5 children would be admitted in one school in a year and that the children would be submitting a transfer certificate of a school abroad, in which they had been studying prior to seeking admission in a Kendriya Vidyalaya.

b) 15 seats for admission in hostels in Kendriya Vidyalayas would be allotted to the children whose parents are going abroad on posting to a station which does not have adequate educational facilities. The required information in this respect would need to be given by the Ministry of External Affairs.

xiv. 15 children of the employees of the Research and Analysis Wing (RAW) would be admitted on orders to be issued by the KVS Hqrs. Of these, a maximum of 5 seats would be given in Delhi and the remaining would be outside Delhi.

xv. “In case adequate number of applications for admission of eligible children are not available for provisions under (XII), (XIII), and (XIV), Kendriya Vidyalaya Sangathan may nominate additional names up to the prescribed limit to ensure full utilization of these provisions”.

xvi. (a) 05 seats in each section of class I, within the approved class strength (40) will be filled by the children of Sponsoring Agency in all schools except those specifically notified otherwise by the Commissioner.

(b) Similarly, 10 seats in all other classes put together (not more than 02 seats in each section) can be recommended by the Chairman VMC for the wards of employees of the sponsoring Agency. These admissions will be over and above the class strength, if otherwise eligible as per KVS Admission Guidelines.

xvii. Chairman, Vidyalaya Management Committee can recommend maximum two admissions in the concerned Kendriya Vidyalaya/Shift under his discretionary quota. These two admissions may be recommended in one class or all classes put together. The children so recommended should be otherwise eligible as per KVS Admission Guidelines (Upto 30th September).

xviii. Wherever land has been sponsored by ODA for Kendriya Vidyalayas located in Delhi, admission to children of regular DDA employees would be restricted to 5 seats per section in class I and 5 seats in all other classes put together. Admission in class I would be within the approved strength of the section while for other classes this would be over and above the class strength.

xix. Each Hon’ble Member of Parliament can refer 10 (ten) cases for admission under the scheme in an academic year but such recommendations shall be confined to children whose parents belong to his constituency either by domicile or on account of having been soon-before posted there or else on account of exigencies of service, migrate to his constituency. Such recommendations would be for admissions in Kendriya Vidyalaya(s) located in his constituency only. In case there is no Kendriya Vidyalaya in the constituency of the Hon’ble M.P.(Lok Sabha), he/she may recommend these admissions in the Kendriya Vidyalaya(s) located in any neighboring contiguous constituency. For Member of the Rajya Sabha, the State from which the member has been elected would be deemed to be his constituency for this purpose. Nominated members of the Rajya Sabha and Lok Sabha can recommend 1 O(ten) cases for admission in any one or more Kendriya Vidyalayas of the Country.

a. These admissions shall be over and above the class strength.

b. These recommendations would be made for all classes except pre-primary, and classes X and XII.

c. These admissions would be made at the beginning of the academic year and no admission would be allowed after the prescribed cut-off date (i.e 31st July) of the year.

d. The recommendations made shall be valid only if these are made in the prescribed format provided to each Member of Parliament by KVS (HQ). Recommendations sent in any other format I manner shall not be considered.

e. The children recommended by Hon’ble Members of Parliament must be otherwise eligible for admission as per the extant KVS Admission Guidelines.

xx. Each Directorate of education of Armed Forces i.e Army, Air Force and Navy and Coast Guards can refer 06 cases in admission in an academic year for all classes except pre-primary and classes X and XII. The Directorate of education of Armed Forces i.e Army, Air Force, Navy and Coast Guard can recommend 06 names for admission of wards of Defence Personnel who are otherwise eligible for admission in Kendriya Vidyalayas located in Defence Sector. These admissions would be over and above the class strength and would be completed by 31 stJuly. However, under this provision no admission will be made in class X and XII.

2. ADMISSION OF WARDS OF ARMED / PARA MILITARY FORCES

Automatic admission of children in the Kendriya Vidyalayas on the basis of transfer certificate issued by the CBSE affiliated schools run by Armed Forces (Army, Air Force, Navy) and Para Military Forces i.e. CRPF/BSF/ITBP/ SSB (Sashastra Seema Bal) and CISF will be entertained only if the parent has been transferred to that place or has desired to settle at the place after his retirement,or transferred to some non-family station or posted in Naxal affected areas and choose to keep the family elsewhere, provided no Armed forces I Para Military Forces i.e.CRPF/BSF/ITBP/ SSB (Sashastra Seema Bal) and CISF run school exists in the place of posting/place of shifting of family.

This provision shall be applicable to schools run by Indian Coast Guard also. This provision may also be extended to the children of government employees studying in schools run by ISRO/AEES (Atomic Energy Education Society).

It is clarified that above provisions are only for the wards of Defence personnel / Para Military Forces i.e.CRPF/ BSF/ ITBP/ SSB (Sashastra Seema Bal) and CISF viz. sons & daughters only. This will not include the grand children of Defence personnel. Provisions of KVS admission guidelines including the eligibility criteria for age and marks/Grades will be followed in letter and spirit. Also the fee including WN is to be paid from the month of admission of the child in the Kendriya Vidyalaya regardless of the fact that the fee for succeeding months have already been paid in the school from which TC has been issued for admission to KV. TCs issued by the CBSE schools of Defence Ministry/Deptts/Authority will be endorsed by the Deputy Commissioner of the region concerned where admission is sought.

3. ADMISSION OF PRE PRIMARY STUDENTS IN CLASS-I.

The policy of automatic admission of pre-primary students in class-I has been withdrawn w.e.f. session 2008-09. Now all admissions in class-I shall be treated as fresh admissions and shall be dealt with as per rules in vogue.

4. CHILDREN WHO WERE EARLIER STUDYING IN KENDRIYA VIDYALAYA but due to (a) transfer of parent or (b) relocation due to exigency caused by posting of parent to field area, were compelled to study in a school other than Kendriya Vidyalaya because no KV was available at that station, be considered for automatic admission in a Kendriya Vidyalaya consequent upon the transfer/movement of the parent subsequently to a place where a Kendriya Vidyalaya exists (Over and above the class strength). A proof to this effect has to be provided by the parent.

PART-C

PROCEDURE FOR ADMISSIONS

1. PUBLICITY

An advertisement shall be issued by the Regional Office in the local newspapers in the 1st week of February giving the admission schedule and inviting Parents to register their wards for admission in Kendriya Vidyalayas. This advertisement should specifically indicate that admissions in Kendriya Vidyalayas are not restricted to Central Govt. employees and are open to all, only certain priorities have been laid down for different categories to regulate the admissions. The reservations for SC, ST and Differently Abled under RTE Act 2009 should also be indicated.

2. REGISTRATION

(i) Registration shall not be done if there is no vacancy or likelihood of any vacancy in a particular class. In case a vacancy arises in future, registration can be made after giving wide publicity at local level and admission can be granted as per KVS Admission Guidelines.

(ii) In case the number of children seeking registration is less because of which are seats have not been filled up, the Principal shall issue a second I third advertisement in the month of May and June notifying the availability of vacancies.

(iii) Admissions are required to be made with the approval of the Executive Committee of the Vidyalaya. In case the Executive Committee does not approve the admissions up to the full sanctioned strength of the class, the Principal shall intimate this fact to the Deputy Commissioner who may approve the admissions.

(iv) Registration for class XI shall be taken up immediately after the declaration of results of class X and admissions up to the full strength of the class should be completed within 30 days after declaration of results by CBSE. In case there is any difficulty in admitting children up to the full strength because of the Executive Committee of the Vidyalaya not approving the same, the procedure as laid down for other classes above Shall be followed and admissions up to the sanctioned strength of the class shall be made by 31st July with the approval of the Deputy Commissioner.

(v) Registration forms shall be made available by the Principal FREE OF COST. (Applicable to offline cases only).

(vi) Registration forms complete in all respects and accompanied by all required documents must be submitted/sent to the Vidyalaya concerned within the prescribed date as per notification of KVS.

(vii) Self Attested copies of the prescribed documents would be required to be submitted along with the application form for registration.

3. DOCUMENTS

• For Class I, certificate of proof of age in the form of a birth certificate issued by the authority competent to register births. This will include certificates from Notified Area Council / Municipality / Municipal Corporation/ extract about the date of birth from records of Village Panchayat, Military Hospital and service records of Defence personnel. For other classes, the date of birth recorded in the transfer certificate issued by a school recognized by the State Education Department would be accepted. The original certificate of date of birth should be returned to the parent after verification. Admissions up to class-VIII may be granted without any school transfer certificate provided the child is otherwise eligible and his birth certificate has been issued by a Govt. body.

• For grandchildren of Hon’ble Member of Parliament and PSU employees a proof of relationship of either of the child’s parents with the Hon’ble Member of Parliament or PSU employees would be needed.

• For grandchildren of KVS employee a proof of relationship of either of the child’s parent with the KVS employee (serving or retired) would be required.

• A certificate that the child belongs to the Scheduled Caste/Scheduled Tribe/EWS/OBC (Non-Creamy Layer)/BPL wherever applicable, issued by the competent authority in concerned State Government/Union Government. The certificate in respect of either of the parents may be accepted initially for the purpose of admission, if this certificate is not available for the child. However, the certificate in respect of the child has to be submitted within a period of 03 months from the date of admission.

• A certificate from the civil surgeon/rehabilitation centre or any other competent authority 36035/5/88/Estt.(sct) defined by the Government of India dated 4.5.1999 certifying the O.M. No. child to be handicapped, wherever applicable. In case, where the handicap of the child can be visually seen by the Principal, the child may be accepted as handicapped even without a certificate. However, the parent may be advised to obtain the relevant certificate from the competent authority and submit the same to the school.

• A service certificate showing the number of transfers during the preceding 7 years duly signed and stamped by the head of office bearing the name, designation and other relevant particulars in block letters.

• A certificate of retirement for uniformed Defence employees.

• Proof of Residence.

Note:

(i) Mere registration will not confer a right to admission.

(ii) Incomplete application forms shall be rejected. In case vacancies remain, Principal may allow completion of the form later at his discretion.

(iii) Admission secured on the basis of any wrong certificate shall be cancelled by the Principal forthwith and no appeal against such action of the Principal shall be entertained.

(iv) When a child is registered for admission in class I in a Kendriya Vidyalaya and before declaration of the selection list its parent is transferred to another station, the child should be deemed to have been registered for admission in the Kendriya Vidyalaya at the station of posting even if the last date of registration at that place has expired. The registration form in original is transferred to the Kendriya Vidyalaya of new place of posting and a photo copy of the same be retained in the school where the child was initially registered.

(v) In respect of Category I, II, III and IV admissions, the veracity of the Certificates submitted by the parents in proof of their service must be invariably verified by the Principal.

4. METHOD OF ADMISSION IN CLASS I

Out of the available seats of fresh admission 15% will be reserved for SC and 7.5% will be reserved for ST. The short fall in the number of seats reserved for SC and ST, will be worked out after considering number of SC/ST children admitted under RTE quota.

(1) In first phase, 10 seats (out of 40 seats) in Class I per section are to be filled as per RTE Provisions (25% of seats) and these 10 seats will be filled by draw of lots from all applications of SC/ST/EWS/BPL/OBC(Non Creamy Layer)/Differently abled(who are residents of Neighbourhood) taken together.

(2) In second phase, remaining seats are to be filled as per existing Priority category system. The short fall in the seats reserved for SC/ST, if any, shall be made good by admitting SC/ST applicants.

For example: In a single Section School 6 seats are reserved for SC and 3 Seats for ST (15% for SC and 7.5% for ST). Assuming that, 2 SC candidates, 1 ST candidate and 1 Differently Abled candidate are admitted under RTE in the lottery system in first phase, then available SC seats will be considered as 6-2 =4 and ST seats will be 3-1 = 2. The left out registered candidates from SC and ST category will be considered as per order of Priority categories for admission. In this case the remaining 24 seats will be available for admission under order of Priority of Category.

Note-1:

a) In no case the seats reserved as per RTE will be de-reserved.

b) The seats reserved for SC/ST may be interchanged, by interchanging SC seats to ST and vice- versa after 20th July

c) If required number of candidates covered under RTE do not register in test spell of registration then a second notification may be given in the month of April.

d) The definition/eligibility criteria of Disadvantaged Group/Weaker Section/BPL/OBC (Non creamy layer) will be as per the notification of the State Government concerned.(The DC KVS RO Concerned may issue guidelines regarding BPL/EWS as per the latest notification of the State Government concerned).

e) Admission test will not be conducted for Class I.

Note-2:

A DEFINITION OF DISADVANTAGED GROUP

1. Child belonging to disadvantaged group means a child belonging to the Scheduled Caste, Scheduled Tribe, Socially and Educationally backward class or such other group having disadvantage owing to social, cultural, economic, geographical, linguistic, gender or such other factor as may be specified by the appropriate government, by notification (Section 2(d) of RTE Act).

2. Child with special needs and suffering from disability will be determined as per the provision mentioned in RTE Act 2009 or as defined by the State Govt concerned.

B DEFINITION OF WEAKER SECTION

  • Child belonging to weaker section means a child belonging to such a parent or guardian (declared by a Court or a Statute) whose annual income is lower than the minimum limit specified by the appropriate government, by notification (Section 2(e)).
  • The income limit regrading economically weaker sections will be applicable as notified by the State Govt. concerned.
C. DEFINITION OF NEIGHBOURHOOD & PROOF OF RESIDENCE((APPLICABLE FOR ADMISSION UNDER RTE ONLY)

Since Kendriya Vidyalayas are located at places with varied density of population,. they have been categorized as follows for determining the limits of neighbourhood:-

1 Major cities and Urban area (All District Hqrs. & Metros) – 5 Kms Radius

2 Places and areas other than included in 1 above. – 8 Kms Radius

Note:

1. Proof of residence shall have to be produced by all applicants. However admission cannot be denied due to non-submission of Proof of residence.

2. A self-declaration in writing from the parent about distance may also be accepted.

5. COMPOSITION OF COMMITTEE FOR DRAW OF LOTS

Every Kendriya Vidyalaya will constitute a Committee for the purpose of monitoring a system of Draw of Lots to be held in Class I or in any other class wherever such stage is reached when all candidates of a particular category or having same number of transfers cannot be accommodated against available number of seats.

The Committee will comprise the following five (05) members:–

• This Committee may be notified with the concurrence of Chairman, VMC, at least 5 days in advance of draw of lots and the same be displayed on School Notice Board.

6. FEE AND OTHER CONCESSIONS :

  • No fee to be charged from the children admitted under the 25% quota prescribed under RTE Act 2009
  • One set of NCERT text books for his/her class to each child will be provided by the school and other expenses on account of note books, stationary, uniform and transport will be reimbursed on production of proper bills in respect of 25% of the children admitted under the Act subject to the ceiling prescribed.
  • Once the children are admitted in Class I under RTE Act, they will continue to enjoy exemptions and concessions till class VIII either in the same KV or any other K.V. moving on transfer.
  • Address proof of the parent should be furnished at the time of registration.
  • The employees who have the facility of fee reimbursement in their departments cannot claim RTE concessions.
7. METHOD OF ADMISSION IN CLASS II TO VIII

Admission test shall not be conducted for admission to Class II to VIII and the admission may be granted based on Priority category system (1 to 5 or 6 as the case may be). If applications are more than the number of seats, lottery system will be followed in each category including single girl child quota (Class VI onwards).

For admission to Class IX, an admission test shall be conducted and a merit list will be prepared for each category of priority separately. Admission shall be granted in the sequence of priority categories in the order of merit.

(i) Admission test shall be conducted in the subjects: Hindi, English, Maths, Social Science and Science.

(ii) There will be only one paper of Admission test of 3 Hours· duration & 100 marks comprising Hindi, English, Maths, Social Science & Science each of 20 marks.

(ii) Candidates must secure 33% marks in aggregate to qualify. Students belonging to SC/ST/Divyang category(PH) will be eligible for admission on securing 25% in aggregate.

9. I. METHOD OF ADMISSIONS IN CLASS XI

KV Students : Admission in different streams viz Science, Commerce, Humanities of Class XI in KVs will be based on CGPA scored in class X examination as under:

a. Science Stream : A Minimum of 7.6 CGPA

b. Commerce Stream : A Minimum of 6.4 CGPA

c. Humanities Stream in class X exam : All students of KV if declared successful

Note: If seats remain vacant in class XI even after admitting the children of KV/ neighboring KVs, then the admissions to non – KV children may be granted on the same criteria in the sequence of categories of priority.

However, there could be instances of lower enrolment in Class XI in some KVs, especially those located in hard stations and remote areas after applying the above criteria for admission. In such an eventuality, Principal of the KV concerned should send the proposal of lowering the eligibility criteria for various streams along with the details of registration, No. of eligible students, etc. to the Deputy Commissioner of the region. The Deputy Commissioner may use her/his discretion in lowering the eligibility criteria to the extent as indicated below:-

a. Science Stream : A Minimum of 6.4 CGPA
b. Commerce Stream : A Minimum of 6.0 CGPA
c. Humanities Stream exam. : All students of KV if declared successful in Class X

Note:- If seats remain vacant in class XI even after admitting the children of KV/ neighbouring KVs then the admissions to non – KV children may be granted on the same criteria, in the sequence of categories of priority.

Concessions wherever applicable shall be incorporated while preparing the Merit List.

a. In case of two or more candidates obtaining equal CGPA. the inter-se merit of such candidates may be determined as follows:

(i) Candidates obtaining higher grade points in Maths will get precedence in admission.

(ii) If two or more candidates have got the same grade points in Maths, then the candidates securing higher grades in Maths and Science taken together will get precedence over the others.

(iii) In case of a tie between two or more candidates obtaining same grade points in maths and science taken together, the student older in age as per the D.O.B will be given precedence over the other.

b. Principal may admit children to class XI only up to the permitted class strength.

c. A student who was earlier not found eligible for admission to a particular stream may be allowed fresh admission to a particular stream in class XI in the next academic session, if he/she improves his/her performance within one year from the same Board.

Note: Informatics Practices as an elective subject is offered to all streams. Admission to this would be granted as per the combined merit list.

Computer Science / Bio-Technology, wherever available as an elective subject, is to be offered to students of Science Stream and admission would be granted as per combined merit list. Multi-media & Web-Designing Technology (wherever available) as elective subject may be offered to students of all the streams (Commerce, Humanities & Science) as per combined merit fist.

II. THE FOLLOWING CONCESSIONS WILL BE ALLOWED FOR ADMISSION FOR CLASS XI.

PRIORITIES IN ADMISSION

The following priorities shall be followed in granting admissions:-

1. KendriyaVidyalayas under Civil/Defence SECTOR

What is considered as salary income?
Section 17​​ of the Income-tax Act defines the term ‘salary’. However, not going into the technical definition, generally whatever is received by an employee from an employer in cash, kind or as a facility [perquisite] is considered as salary.

​What are allowances? Are all allowances taxable?
Allowances are fixed periodic amounts, apart from salary, which are paid by an employer for the purpose of meeting some particular requirements of the employee. E.g., Tiffin allowance, transport allowance, uniform allowance, etc.

There are generally three types of allowances for the purpose of Income-tax Act – taxable allowances, fully exempted allowances and partially exempted allowances.​

​My employer reimburses to me all my expenses on grocery and children’s education. Would these be considered as my income?
​Yes, these are in the nature of perquisites and should be valued as per the rules prescribed in this behalf.​​

​During the year I had worked with three different employers and none of them deducted any tax from salary paid to me. If all these amounts are clubbed together, my income will exceed the basic exemption limit. Do I have to pay taxes on my own?
​Yes, you will have to pay self-assessment tax and file the return of income.​

​If I receive my pension through a bank who will issue Form-16 or pension statement to me- the bank or my former employer?
​​The bank.​

​Are retirement benefits like PF and Gratuity taxable?
​​In the hands of a Government employee Gratuity and PF receipts on retirement are exempt from tax. In the hands of non-Government employee, gratuity is exempt subject to the limits prescribed in this regard and PF receipts are exempt from tax, if the same are received from a recognised PF after rendering continuous service of not less than 5 years.​

​Are arrears of salary taxable?
​​​​Yes. However, the benefit of spread over of income to the years to which it relates to can be availed for lower incidence of tax. This is called as relief u/s 89​ of the Income-tax Act.​​

​Can my employer consider relief u/s 89 for the purposes of calculating the TDS from salary?
​​Yes, if you are a Government employee or an employee of a PSU or company or co-operative society or local authority or university or institution or association or body. In such a case you need to furnish Form No. 10E to your employer. ​​

​My income from let out house property is negative. Can I ask my employer to consider this loss against my salary income while computing the TDS on my salary?
​Yes, however, losses other than losses under the head ‘Income from house property’ cannot be set-off while determining the TDS from salary.​​

​Is leave encashment taxable as salary?
​​It is taxable if received while in service. Leave encashment received at the time of retirement is exempt in the hands of the Government employee. In the hands of non-Government employee leave encashment will be exempt subject to the limit prescribed in this behalf under the Income-tax Law.​

​Are receipts from life insurance policies on maturity along with bonus taxable?​
​​​
As per section 10(10D), any amount received under a life insurance policy, including bonus is exempt from tax. However, following receipts would be subject to tax:

Any sum received under sub-section (3) of section 80DD; or
Any sum received under Keyman insurance policy; or
Any sum received in respect of policies issued on or after April 1st, 2003, in respect of which the amount of premium paid on such policy in any financial year exceeds 20% (10% in respect of policy taken on or after 1st April, 2012) of the actual capital sum assured; or
Any sum received for insurance on life of *specified person (issued on or after April 1st 2013) in respect of which the amount of premium exceeds 15% of the actual capital sum assured.

* Any person who is –

i) A person with disability or severe disability specified under section 80U​; or

ii) suffering from disease or ailment as specified in the rule made under section 80DDB.

Following points should be noted in this regard:
Exemption is available only in respect of amount received from life insurance policy.
Exemption under section 10(10D)​ is unconditionally available in respect of sum received for a policy which is issued on or before March 31, 2003.
Amount received on the death of the person will continue to be exempt without any condition.​

7th Pay Commission: Committee on Allowances likely to present its report today

The Committee on Allowances, headed by Finance Secretary Ashok Lavasa, was given time till February 22 to present its report.

It has been nearly eight months since the Narendra Modi government cleared the recommendations of the Seventh Pay Commission .

After a long wait, the Committee on Allowances is likely to submit its report to Finance Minister Arun Jaitley on Monday.

The committee, headed by Finance Secretary Ashok Lavasa, was given time till February 22 to table its report.

The revised allowances are likely to be effective from April 1.

The house rent allowance (HRA), which forms a crucial part of government employees' salary, is expected to be fixed at 30 per cent of the basic pay for employees in metros which have a population of 50 lakh and above.

HERE IS ALL YOU NEED TO KNOW:


  • The Seventh Pay Commission had recommended 24 per cent of the basic pay as HRA against the 30 per cent of basic pay under the Sixth Pay Commission.
  • The Committee on Allowances was formed in July last year to review the recommendations of the pay commission after employees protested against the proposed slash in the HRA. The pay commission also recommended doing away with 53 of the 196 allowances and merging a few others.
  • The committee was initially given four months to table its report, which was later extended to February 22, 2017. If reports are to be believed, the Central government is likely to move ahead with the committee's report after March 15 when Assembly elections will be over.
  • If the government decides to pay a 30 per cent of basic pay as HRA to its employees, the cost estimate comes to Rs 29,300 crore in the first year.
  • The hiked salary is given in two parts to government employees, in the form of basic pay and allowances.
  • While the increase in basic pay is calculated on a back-date basis, making employees eligible for arrears, the hike in allowances is applicable from the date the government implements it. As a result, employees are not entitled to arrears in this case.
  • It is widely believed that the government has effectively saved a lot of money this financial year by not making an announcement on allowances. Government employees, on the other hand, have expressed their disappointment over being denied their full remuneration over a prolonged period.

Subject: Setting up of Anomaly Committee to settle the anomalies arising out of the implementation of the Seventh Pay Commission’s recommendations.

The undersigned is directed to refer to [DoPT’s OM of even number dated 16/8/2016 ##eye##] and to incorporate the following modification in the definition of anomaly:

2. With the incorporation of the above para in the O.M., the definition of anomaly will read as follows:

(1) Definition of Anomaly

Anomaly will include the following cases;

a) Where the Official Side and the Staff Side are of the opinion that any recommendation is in contravention of the principle or the policy enunciated by the Sixth Central Pay Commission itself without the Commission assigning any reason;

b) Where the maximum of the Level in the Pay Matrix corresponding to the applicable Grade Pay in the Pay Band under the pre-revised structure as notified vide CCS(RP Rules 2016, is less than the amount an employee is entitled to be fixed at, as per the formula for fixation of pay contained in the said Rules;

c) Where the Official side and the Staff Side are of the opinion that the vertical and horizontal relativities have been disturbed as a result of the 7th Central Pay Commission to give rise to anomalous situation.

3. The rest of the content of the O.M. dated 16.08.2016 shall remain unchanged.

A meeting of the Sub-Committee-III to suggest measures for streamlining the implementation of the National Pension System (NPS) was held under the Chairmanship of Ms. Vandana Sharma, Additional Secretary (Pension) with Staff Side of JCM on 10.02.2017 at 3.00 p.m.,at Lok Nayak Bhawan, New Delhi. 2. Additional Secretary (Pension) welcomed all the participants and briefed the Staff Side of JCM about the various issues allocated to the Sub-Committee-III. She invited suggestions from the participants on these issues.

3. The Staff Side handed over a communication dated 10.2.2017 containing their views on the various issues allocated to the Sub Committees. The Staff Side agreed that there is an urgent need to frame rules on the service matters of the NPS employees. Additional Secretary (Pension) assured the staff side that their views would be duly considered while framing rules in this regard.

4. Staff Side of the JCM emphasized that the Government employees should be excluded from the purview of NPS. In case, it was not possible to exempt the Government employees from the NPS, a minimum pension @ 50% of the last pay drawn or average emoluments of the last 10 months, whichever is more beneficial to the employees (along with dearness relief) may be ensured to all NPS employees on their retirement.

5. The Staff side was informed that in the event of invalidation / disability or death of the NPS employee, Pension / Family Pension as per the rates applicable under CCS (Pension) Rules is available to the NPS employees / their families. As regards the minimum guaranteed pension on retirement of the NPS employees, the views of the Staff Side of JCM would be conveyed to the Committee set up for streamlining implementation of the National Pension System.

The meeting ended with a vote of thanks to the chair.

7th Pay Commission revised allowances are expected to be effective from April 1: Zee News

7th Pay Commission: Central govt employees may receive revised allowance in April

Seventh Pay Commission panel that reviews allowances, headed by Finance Secretary Ashok Lavasa, is likely to submit its revised report to Finance Minister Arun Jaitley by next month, a report said. 

Apart from Holi mood, giving one more reason to central government employees, the Centre is expected to make official announcement on the allowances soon after the State assembly elections get over. The last day of state polls is March 11, as reported by Hindu Business Line. 

Hence, the revised allowances are expected to be effective from April 1. 

As per the report, the panel has recommended that the rate of house rent allowance to be revised and allow higher allowance in order to balance higher cost of living.

Moreover, NDTV report had said that the 7th Pay commission had recommended that HRA be revised to 27%, 18% and 9% respectively when Dearness Allowance (DA) crosses 50%. While the rates should be revised to 30%, 20% and 10% when DA crosses 100%. 
Quoting a senior official, The Hindu report added that the impact of revised and higher allowances has already been added in the the Union Budget 2017-18. This has increased the allocation for allowances by 7%. 

Reportedly, the 7th Pay Commission had examined 196 existing allowances. It had recommended abolition of 51 allowances and subsuming of 37 allowances.

Last year in June, the Union Cabinet chaired by Prime Minister Narendra Modi had approved the much-awaited 7th Pay Commission recommendations.

Minutes of the 29th Meeting of Standing Committee of Voluntary Agencies(SCOVA) held on 12.01.2017 under the Chairmanship of Hon’ble MOS(PP) at Vigyan Bhawan Annexe, New Delhi.

The 29th meeting of Standing Committee of Voluntary Agencies (SCOVA) was held under the chairmanship of Hon’ble MOS(PP) on 12.01.2017.

At the outset, Secretary (P&PW) welcomed the representatives of Pensioners Associations and the participating officers from various Ministries/Departments.

2. Secretary (P&PW),- said that some issues of the last SCOVA meeting have been resolved. Two review meetings were held with Defence Pensioners Associations, SCOVA and Ministry of Defence on 27.09.2016 and 20.12.2016 to resolve issues relating to Defence pensioners pending in SCOVA for a long time.

3. He said that this Department has implemented Government’s decision on the recommendations of the 7th CPC for revision of pre-2016 pensioners/family pensioners etc. There is no change in the pension fixation formula for those retired/retiring on or after 01.01.2016. The minimum pension has been increased to Rs. 9000/- per month against the existing Rs.3500/- per month. The ceiling of gratuity has been increased from existing Rs.10 lakhs to 20 lakhs per month. The rates of ex-gratia lump sum compensation being paid to the families of employees who die in performance of duty has been increased from existing Rs. 10-15 lakh to Rs. 25-35 lakh, depending upon the circumstances in which the death occurs. He further stated that approximately 85% percent grievances have been disposed of by this Department.

4. Thereafter, the Action Taken Report on the decisions of the 28th SCOVA meeting and Fresh Agenda Items of the 29th SCOVA meeting were taken up for discussion.

5. Discussion on ATR of 28th SCOVA meeting:-

(i) Revision of PPOs of pre-2006 pensioners.

CPAO intimated that the issue of revision of the remaining 3200 PPOs for pre-2006 pensioners has been reviewed with banks. The main reason for pendency is non-availability of records. CPAO would prepare fresh list of live pending cases on the basis on e-scrolls which would be provided to the concerned Ministries/Departments to review the pendency. The Ministries/Departments have been asked to give certificates of non-availability of records. The banks have also been asked to do KYC when the pensioners visit them for life cert.-Mc-ate. CPAO also informed that they have not received any grievances in respect of non-revision of these particular PPOs.

Since CPAO has expressed reservation about the pending cases, it was decided that CPAO would examine these cases under Audit and treat the pendency as NIL, subject to outcome of Audit.

Ministry of Defence intimated that 2368 (2470) PPOs of Air Force pensioners have been revised. Some discrepancies have been noted which will be resolved within a week. CGDA was requested that the list of cases be shared with the Directorate of Air Veterans (DAV) and with the Air Force Association, New Delhi. DAV would tally the list with their records and revert back with the list of pending cases. On the issue of PPOs of Ordnance Factory, Ambarnath, CGDA committed that the pendency will be disposed of by first week of February, 2017.

It was decided that DoPPW will hold a tripartite meeting with Department of Ex-servicemen Welfare, Directorate of Air Veterans and Defence Pensioners Associations of SCOVA.

Department of Telecom reported that one of the reasons for pendency of 203 cases was that the Maharashtra Circle did not have relevant records. The Department was asked to dispose of the pendency within a week.

It was said that the actual revision of pension had been carried out for all cases, the review was only with reference to issue of revision authorities. The revision authorities would be pending only for those pensioners/family pensioners who are not traceable. Therefore, the matter was decided to be closed. The Ministries/Departments would continue their efforts to attend to specific grievances to trace old records and issue revision authorities at the earliest.

(ii) Health Insurance Scheme for pensioners including those residing in Non-CGHS area.

Ministry of Health informed that the final EFC Memo is under submission to the Secretary. The proposal covers Central Government civil employees and pensioners only and that too for indoor treatment. OPD and appliancyould not be covered under the proposed scheme.

Disabled War Veterans (India) raised the issue of covering prosthesis under this scheme and stated that this will facilitate rehabilitation. The Hon’ble MOS(PP) observed that the prosthesis of good quality are now available. It was decided that Secretary (P&PW) will have a meeting with the Department of Empowerment of Persons with Disabilities and Ministry of Health and Family Welfare to discuss the question of covering prosthesis for Civil Government employees/pensioners under CGHS/Medical Insurance.

(iii) Special “Higher” Family Pension for widows of the war disabled invalided out of service.

Ministry of Defence has stated that the comments of Service Headquarters on the issue have been sought vide MOD ID Note dated 10.10.2016 which are still awaited.

The Disabled War_Veterans (India) Association, stated that the cases would cover Army personnel mostly and not Navy and Air Force personnel. Department of Ex-servicemen Welfare was requested to arrange a meeting of the concerned Joint Secretary with the Disabled War Veterans(India) to discuss and finalise the issue within a month.

It was decided that Secretary(P&PW) will write to Secretary(ESW) to finalise the issue expeditiously .

(iv) Extension of CGHS facilities of P&T pensioners.
(ix) Conversion of Postal Dispensary at Cantt. Road Cuttack to CGHS Wellness Centre

The Ministry of-Health and Family Welfare informed that the recommendation of 7th CPC in this regard is under consideration of the “Allowances Committee” set up after 7th CPC. Department of Expenditure was requested to check and confirm whether the issue is actually under the purview of the “Allowances Committee”. DoPPW will independently seek clarification from the Implementation Cell, Department of Expenditure

(v) Anomaly in fixation of pension of DoT employees absorbed in BSNL retired between 01.10.2000 and 31.07.2001.

Department of Telecom informed that, as desired by the Department of Expenditure, financial implications on—the formula suggested by DoPPW was being worked out in consultation with BSNL. Meanwhile, CAT Principal Bench has allowed a petition filed by the BSNL absorbee pensioners for fixing their pension only on the basis of IDA pay drawn after absorption in BSNL. Department of Telecom was requested to examine the judgement of CAT.

(vi) Merger of 78.2% IDA with basic pension benefit to absorbed BSNL pensioners.

Department of Telecom informed that consequent on approval of the Cabinet, the necessary instructions were issued to the concerned CCAs vide OM dated 18.07.2016. Therefore, the matter was closed.

(vii) Extension of benefit of upgraded Grade Pay to pre-2006 retirees of S-12 grade (issue of grant of grade pay of Rs.4600/- instead of Rs.4200/-)

Department of Expenditure has observed that the upgraded Grade Pay of Rs. 4600/-was given subsequently outside the recommendation—Of the 6th CPC. Since this up-gradation is post 6th CPC decision, it is not applicable to those who are holding the pre-revised scale of Rs.6500-10,500/- and retired before 01.01.2006. Department of Telecom informed that the benefit of Grade pay of Rs.4600/- to pre-2006 pensioners in pre-revised pay scale of Rs.6500-10,500/- is sub-judice.

(viii) Issues relating to CGHS Wellness Centre, Dehradun- Merger of Survey of India Dispensary in CGHS on the same lines as P&T.

Ministry of Health and Family Welfare informed that the 0/o Surveyor General of India has conveyed that Survey of India dispensaries were established as per the obligations under Factories Act. Therefore, their merger with CGHS on the same lines as in the case of P&T dispensaries is not possible.

Ministry of Health and Family Welfare was requested to examine as to how the provisions of the Act come in the way of merger of these dispensaries with CGHS, particularly when the doctors in these dispensaries are also provided by Ministry of Health under CGHS. Ministry of Health and Family Welfare has stated that they have taken a decision to post 2 more contractual doctors in the CGHS Wellness Centre, Dehradun. Ministry of Health and Family Welfare was requested to post doctors expeditiously.

(x) Stoppage of Recovery of wrongful/excess payments from Railways Pensioners.

Ministry of Railways informed that the matter regarding waiver of recovery and withdrawal of the petition filed in the Court was submitted for the approval of Railway Board and a decision was likely to be taken in 3-4 days. The item was closed.

(xi) Delay in commencement of family pension to spouse on death of pensioners.

CPAO intimated that the relevant instructions have been issued on 02.06.2016 . 12 Banks have reported timely commencement of family pension. However, CPAO will revert to the banks based on the reports of the e-scrolls. Also internal audit of the banks at CPPCs are conducted to check the delay. Secretary(P&PW) directed to circulate the copies of instruction issued by CPAO. CPAO will send a report on the delayed cases within a month and DoPPW will take up the issue with the Department of Financial Services.

(xii) Payment of (i) Restoration of commutation amount and (ii) Additional Pension on attaining the age of 80 years should be streamlined by the Banks.

CPAO intimated that the relevant instructions have been issued on 02.06.2016 . Secretary(P&PW) directed to circulated the copies of instruction issued by CPAO. CPAO will send a detailed report on the delayed cases within a month and DoPPW will take up the issue with the Department of Financial Services based on the report received from CPAO.

6. Discussion on Fresh Atenda Items

(29.1) Item wise details of payment made to be shown in Pass Books of Pensioners.

CPAO intimated that instructions are in place to indicate the break-up of various payments to the pensioners at the time of payment of pension. All heads of CPPCs and Government Accounts Departments of the banks have been instructed to streamline their internal system to enforce the existing guidelines. A “Web responsive Pensioners Service” (WRPS) was launched by CPAO which enables the pensioners/family pensioners to see details of pension like monthly pension, DR, Medical Allowance, DA arrears, Commission/Other arrears, recoveries etc. Secretary (P&PW) directed to send copies of relevant CPAO instructions to the various Pensioners Associations and also to take up the matter with Department of Financial Services.

(29.2) Amendment/Revision in notification of Life Certificate.

It was clarified that Digital Life Certificate is an additional facility. CPAO stated that there are 3 options for submission of Life Certificate:-

(i) By presenting himself/herself to the authorised bank officer to record the life certificate

(ii) By producing a Life Certificate in the prescribed Proforma signed by any of the person specified in para 15.2 of the Scheme for payment of pensions to Central Government Civil Pensioners by authorised Banks.

(iii) Though Aadhar based Biometric Authentication system.

Therefore the item was closed.

(29.3) Additional Pension for recipients of disability pension of age 80 years and above.

Department of Ex-servicemen Welfare(DESW) intimated that the issue is under examination. Secretary(P&PW) asked DESW to expedite the matter.

(29.4) Upgradation of Polyclinic at Bajaj Nagar, Jaipur.

Ministry of Health and Family Weflare informed that the instructions have been issued to Addl. Director(CGHS), Jaipur to make necessary arrangements for repairing the instruments and machinery lying unused and for procurement of equipment for diagnostic facilities like X Ray, Dental X-Ray, Auto Analysers etc. Ministry of Health and Family Welfare stated that up-gradation of facilities will be completed by 31.03.2017.

(29.5) Setting up of CGHS Wellness Centre at Kochi.

The Ministry of Health and Family Welfare intimated that the proposal regarding opening of CGHS Wellness Centre at Kochi is under active consideration.

(29.6) Empanelment of Hospitals/Health Centre with CGHS in Ambarnath/Dombivli.

Ministry of Health stated that there are 9 empanelled hospitals in Ambemath/Dombivli. The 14 enlisted hospitals in the fresh agenda do not satisfy the criteria of minimum 40 beds for empanelment. The pensioners association requesterif the above condition may be relaxed for the empanelment of these hospitals.

7. In view of the large number of unresolved issues relating to CGHS, it was decided that a special review meeting on Health issues will be chaired by Secretary (P&PW). the concerned Associations would also be invited to participate.

8. Concluding the session, Hon’ble MOS(PP) said that it had been a very meaningful and stimulating interaction, which is indicative of the efforts being made by the Department of Pension & Pensioners’ Welfare. since the population of retired people is steadily increasing, there is a need to put in place an institutional mechanism to make good use of the knowledge, experience and efforts of the retired employees. He also stated that the pensioners are a healthy and productive workforce and we need to streamline and channelize their energies, thereby making pensioners a part of nation building process. He expressed satisfaction that approximately 88% of the pension accounts have been linked with the Aadhaar numbers and that pensioners will now be able to benefit from the ‘Jeevan Pramaan’ initiative of the Government.

NJCA chief Shiv Gopal Mishra confirmed that the allowances report would be submitted on Wednesday.

New Delhi, Feb 21: Committee on allowances, headed by Finance Secretary Ashok Lavasa, will submit its report tomorrow, claims National Joint Council of Action (NJCA) convenor Shiv Gopal Mishra. Central government employees were expecting the report to be tabled by Monday. However, the committee delayed the submission due to unspecified reasons. The report would pave the way for the implementation of hiked allowances as per the revised 7th Pay Commission recommendations.

“Government has made no announcement yet. But the report by Committee on allowances would be tabled tomorrow,” Shiv Gopal Mishra said, while speaking exclusively to India.com. On being asked whether the government would make an announcement in relation to the arrears on allowances, he replied, “Let us see what comes out of the report. We are expecting the hike in allowances, as per our demands. We have to wait and see whether the government makes an announcement on arrears as well.”

The committee on allowances was formed in July 2016, after central government employees raised several anomalies related to the 7th Pay Commission report submitted by Justice (retd) AK Mathur. The 7CPC report had recommended the abolition of 51 existing allowances, and subsumption of 37 others of the total 191 allowances.

The major point of grievance was the reduction in Housing Rent Allowance (HRA) offered to central government employees. As per the 6th Pay Commission report, the HRAs provided were 30 per cent, 20 per cent, 10 per cent for employees living in ‘X’, ‘Y’, ‘Z’ category towns/cities. However, the 7th Pay Commission report decreased the allowances to 24, 16 and 8 per cent of the basic pay.

Reduction in HRA has irked a major section of central government employees, who reside in rented accommodations. A section of the aggrieved employees have blamed the top bureaucracy for the delay in HRA hike. “Naturally, the common central government employees are more affected by the delay in allowance hike. The top bureacrats don’t take higher allowances, therefore, they are not interested in the hike,” Mishra said.

Apart from the hike in allowances, central government employees have also demanded Centre to provide arrears on the allowances. Since the date of implementation of 7th Pay Commission was fixed as January 1, 2016, employees have demanded the release of arrears on allowances as well.

Although the government provided arrears on basic pay while hiking the salaries on July 1, indications have been made that no arrears would be released on allowances. NJCA has confirmed that the employee unions would launch protest across the nation if the allowances are hiked, without the arrears. “Arrears are unlikely, but protests would be launched if they fail to release (the arrears),” Mishra said.

The date of allowances hike is reported to be April 1. NJCA claims, through its sources, that the government would be implementing the allowance hike from April 1. “It is most likely that the government announces the hike by April 1,” Mishra confirmed.

Ans. Normally, family pension to spouse is sanctioned and authorized at the time pension is authorized in favour of retiring government servant and indicated in the pension payment order and is to be drawn after the death of the pensioner.

However, in cases where Govt. servant expired while in service, the widow or widower has to apply in Form 14 (of CCS Pension Rules) to the Head of Office concerned who will sanction and authorize the family pension through its Pay Accounts Officer. Where the deceased Govt. servant is survived only by a child or children, the guardian (in case of minor child /children) or such child or children may submit a claim in Form 14 to the Head of Office for sanction and authorization of family pension. For getting family pension, the deceased pensioner's family should apply in Form no. 14 along with a copy of the death certificate of the deceased pensioner to:

I) The pension disbursing authority if, the amount of family pension is already indicated in the Pension Payment Order.

(II) The Head of Office for sanction of family pension in all other cases. If the pensioner has loint Account with the spouse on either or survivor basis the spouse has to submit the death certificate of the pensioner along with simple application only to activate the family pension.

A union body of central government employees today met members of the Ashok Lavasa committee over HRA or housing rent allowance related to Seventh Pay Commission. Shiv Gopal Mishra, the convenor of National Joint Council of Action (NJCA), a joint body of unions representing central government employees, said the union body held final round of talks with the panel members on HRA related to Seventh Pay Commission. The panel on allowance related to HRA will soon finalise its recommendations to the government, the union leader said. 

The panel headed by Finance Secretary Ashok Lavasa is reviewing Seventh Pay Commission allowances. The government had in June accepted the recommendation of Justice AK Mathur-headed Seventh Pay Commission in respect of the hike in basic pay and pension but its suggestions relating to allowances were referred to the committee. The Seventh Pay Commission had examined a total of 196 existing allowances and, by way of rationalisation, recommended abolition of 51 allowances and subsuming of 37 allowances.

The committee on allowances was initially given a time of four months to submit its report to the finance minister. Till a final decision is taken, all existing allowances are being paid at the Sixth Pay Commission rates.   

The Seventh Pay Commission had recommended that HRA be paid at the rate of 24 per cent, 16 per cent and 8 per cent of the new Basic Pay, depending on type of cities.

The Seventh Pay Commission had also recommended that the rate of HRA be revised to 27 per cent, 18 per cent and 9 per cent respectively when DA crosses 50 per cent, and further revised to 30 per cent, 20 per cent and 10 per cent when DA crosses 100 per cent.

Typically, in case of housing allowance, arrears are not paid.

Allowances form a significant chunk of government employees' salary. Some analysts had earlier said that implementation of the housing allowance portion of the Seventh Pay Commission as well as GST or Goods and Services Tax could push up average inflation.

"At worst, if the government is under pressure, this allowance can be pushed to the next year, as was done in the previous pay commissions. The housing allowance does not attract arrears," HSBC Securities had said in an earlier report.

The Cabinet had also decided to constitute two separate committees to suggest measures for streamlining the implementation of National Pension System (NPS) and to look into anomalies likely to arise out of implementation of the Commission's Report.

नई दिल्ली: केंद्रीय कर्मचारियों के लिए आज काफी अहम दिन है. सातवें वेतन आयोग को लेकर उठे कई मुद्दों में कर्मचारियों ने एचआरए की दर पर भी आपत्ति जताई थी. सरकार ने इस मुद्दे को वित्त सचिव अशोक लवासा के नेतृत्व में समिति का गठन कर कर्मचारियों का पक्ष जानने का प्रयास किया और कर्मचारियों के प्रतिनिधियों से बातचीत आरंभ की. कई दौर चली बातचीत के बाद मामला अपने अंतिम पड़ाव पर है. सूत्रों से मिली जानकारी के अनुसार आज इस मुद्दे पर कर्मचारी पक्ष और सरकार के बीच अंतिम दौर की बातचीत हुई. सूत्र बता रहे हैं कि वित्त सचिव अशोक लवासा की आज तबीयत कुछ नासाज थी, इस वजह से बातचीत विस्तार से नहीं हुई, लेकिन माना जा रहा है कि बातचीत अब पूरी हो चुकी है और इसी के आधार पर अंतिम निर्णय ले लिया जाएगा. जल्द ही यह भी पता लग जाएगा कि सरकार ने इस बारे में क्या निर्णय लिया है.

इस संबंध में एनजेसीए के संयोजक शिवगोपाल मिश्रा ने एनडीटीवी को बताया कि आज इस मुद्दे पर बातचीत होगी. उन्हें उम्मीद है कि सरकार कर्मचारियों की मांग पर सकारात्मक रुख अख्तियार करे. जानकारी के लिए बता दें कि कर्मचारियों की मांग है कि एचआरए को पुराने फॉर्मूले के आधार पर तय किया जाए या फिर इसकी दर बढ़ाई जाए. वर्तमान में तय फॉर्मूला के हिसाब से एचआरए कर्मचारियों को पहले की तुलना में कम मिलने लगा है.

बता दें कि सातवें वेतन आयोग (7th Pay Commission) द्वारा केन्द्रीय कर्मचारियों को दिए जाने वाले कई भत्तों को लेकर असमंजस की स्थिति है. नरेंद्र मोदी सरकार ने 2016 में सातवें वेतन आयोग (Seventh Pay Commission) की सिफारिशों को मंजूरी दी थी और 1 जनवरी 2016 से 7वें वेतन आयोग की रिपोर्ट को लागू किया था. लेकिन, भत्तों के साथ कई मुद्दों पर असहमति होने की वजह से इन सिफारिशें पूरी तरह से लागू नहीं हो पाईं. माना जा रहा है कि अशोक लवासा समिति ने अपनी रिपोर्ट लगभग तैयार कर ली है और आज की बैठक के बाद रिपोर्ट को अंतिम रूप दे दिया जाएगा. माना यह भी जा रहा है कि जल्द ही यह रिपोर्ट वित्तमंत्री अरुण जेटली को सौंप दी जाएगी.

कहा जा रहा है कि सरकार की ओर से बातचीत के लिए अधिकृत अधिकारी एचआरए को 1 स्तर ऊपर करने को तैयार हुए हैं अब एचआरए 30%, 20% और 10% तक हो सकता है.

वहीं, विश्वसनीय सूत्रों के हवाले से खबर मिल रही है कि बड़े शहरों में इसे 30 प्रतिशत किया जा सकता है, लेकिन यह अभी तय नहीं है. कर्मचारी संगठन का कहना है कि अगर सरकार ने एचआरए बढ़ाया नहीं है तो घटा कैसे सकते हैं. उनका तर्क है कि क्या शहरों में मकान का किराया कम हुआ है. क्या मकान सस्ते हो गए हैं. जब यह नहीं हुआ है तो सरकार अपने कर्मचारियों के साथ अन्याय कैसे कर सकती है. सूत्र बता रहे हैं कि सरकार तक कर्मचारियों की मांग पहुंचा दी गई है और अब सरकार के भीतर इस मसले पर बातचीत होगी.

बता दें कि वेतन आयोग (पे कमीशन) ने अपनी रिपोर्ट में एचआरए को आरंभ में 24%, 16% और 8% तय किया था और कहा गया था कि जब डीए 50 प्रतिशत तक पहुंच जाएगा तो यह 27%, 18% और 9% क्रमश: हो जाएगा. इतना ही नहीं वेतन आयोग (पे कमिशन) ने यह भी कहा था कि जब डीए 100% हो जाएगा तब यह दर 30%, 20% और 10% क्रमश : एक्स, वाई और जेड शहरों के लिए हो जाएगी.

उल्लेखनीय है कि कर्मचारियों के संयुक्त संगठन एनसीजेसीएम ने वेतन आयोग को सौंपे अपनी मांगों से संबंधित ज्ञापन में इस दर को क्रमश: 60%, 40% और 20% करने के लिए कहा था. संगठन का आरोप है कि आयोग ने कर्मचारियों की मांग को पूरी तरह से ठुकरा दिया था. उनका कहना है कि वेतन आयोग ने इस रेट को छठे वेतन आयोग से भी कम कर दिया है. इनका कहना है कि क्योंकि इसे डीए के साथ जोड़ा गया है तो यह तभी बढ़ेगा जब डीए की दर तय प्रतिशत तक बढ़ जाएगी.

कहा जा रहा है कि सरकार से बातचीत में यह भी तय होने की संभावना है कि एचआरए की दर शहरों की कैटेगरी के अनुसार से दूसरे तय प्रतिशतों के स्तर के हिसाब से लागू हो जाए.

जानकारी के लिए बता दें कि सातवां वेतन आयोग से पहले केंद्रीय कर्मचारी 196 किस्म के अलाउंसेस के हकदार थे. लेकिन सातवें वेतन आयोग ने कई अलाउंसेस को समाप्त कर दिया या फिर उन्हें मिला दिया जिसके बाद केवल 55 अलाउंस बाकी रह गए. तमाम कर्मचारियों को कई अलाउंस समाप्त होने का मलाल है. क्योंकि कई अलाउंस अभी तक लागू नहीं हुए और कर्मचारियों को उसका सीधा लाभ नहीं मिला है तो कर्मचारियों को लग रहा है कि वेतन आयोग की रिपोर्ट अभी लागू नहीं हुई

बता दें कि सातवें वेतन आयोग की रिपोर्ट से कर्मचारियों को कई शिकायतें रही हैं और ऐसे में केंद्र की नरेंद्र मोदी सरकार ने अपने कर्मचारियों की शिकायतों को दूर करने के लिए संबंधित मंत्रालय और वित्तमंत्रालय के अधीन समितियों का गठन किया है. ये समितियां कर्मचारी नेताओं से बात कर रही हैं और इस समितियों को अपना फैसला चार महीने में सरकार को देना था लेकिन अभी तक सात महीने से ज्यादा समय बीत चुका है और अभी तक किसी भी समिति ने अपनी रिपोर्ट नहीं सौंपी है.

New Delhi, Feb. 22: The UGC today recommended a 20 per cent pay hike for university and college teachers.

A performance-linked promotion system has been suggested with stress on research. The retirement age will remain unchanged at 65.

The recommendations, made by a five-member committee, have to be accepted by the HRD ministry. If approved, the hike will be the first such revision in more than a decade and cover nearly 30,000 teachers in central universities and over four lakh in state varsities and colleges.

The panel has suggested that the new salaries be paid with retrospective effect from January 2016. The UGC cleared the report without changes.

According to the recommendations, a teacher's starting package will be revised by a multiplier of 2.72, applied to the basic salary and another component called academic grade pay (AGP).

For instance, a directly recruited professor who gets around Rs 43,000 as basic salary, Rs 10,000 as AGP and dearness allowance now will be entitled to a basic salary of Rs 1.44 lakh which would subsume the present dearness allowance. 

The Seventh Pay Commission, whose report was accepted last year for civil servants and other central staff, had used the 2.72 multiplier.

The last revision for teachers in 2006 had put their package higher than that of civil servants at the entry level. Teachers may continue to retain the edge even under the revised structure, sources said.

Furqan Qamar, the secretary-general of the Association of Indian Universities (AIU), said university and college salaries had been kept higher to attract talent.

On promotions, the current determinants are indicators like teaching and research output. The UGC panel, headed by Prof. V.S. Chauhan, has suggested that more stress be laid on quality research, such as papers published in reputable journals, the sources said.

The UGC has forwarded to all central universities a finance ministry order suggesting the Centre will bear no more than 70 per cent of the additional expenses arising out of the revised pay. This order covers autonomous institutions, including central universities.

The higher education regulator has asked the 40-odd central universities to specify how much internal resources they can generate, indicating the possibility of a hike in tuition fees.

The new pay proposals are not binding on state universities, which have to fund the higher salaries from their own resources. But they have usually adopted such suggestions in the past.

The Union HRD ministry has set up a separate committee for salary revision of teachers in technical institutions like the IITs and the IIMs.
