7th Pay Commission Latest News Today 2018: The government has rejected a long-standing demand of the armed forces for higher Military Service Pay (MSP) for over 1.12 lakh military personnel including Junior Commissioned Officers of the Army, official sources said Tuesday.

They told PTI that the Army headquarters is “very anguished” over the decision by the Finance Ministry, and will seek its immediate review.

Around 1.12 lakh military personnel including 87,646 JCOs and 25,434 personnel of equivalent rank from the Navy and the Indian Air Force will be affected by the decision.

The demand was to increase the monthly MSP from Rs 5,500 to Rs 10,000 and the total annual financial outgo would have been Rs 610 crore if the government had accepted the demand, sources said.

The MSP for the military personnel was introduced recognising their unique service conditions and hardships.

“The proposal for higher MSP for JCOs and equivalent rank of the Navy and IAF has been rejected by the Finance Ministry,” said a source.

At present, the MSP has two categories — one for officers and another for JCOs and jawans.

The seventh Pay Commission had fixed Rs 5,200 as MSP per month for JCOs and jawans while putting it at Rs 15,500 for officers between Lieutenant-rank and Brigadier-rank.

The Army has been pressing for granting an higher MSP to the JCOs, arguing that they are gazetted officers (Group B) and play a very vital role in command and control structure of the force.

“Since JCOs are Group B gazetted officers and also have considerable length of service, it is incorrect to grant them MSP on par with the jawans. It is very unfair,” said a military officer who wished not to be named.

The Army had taken up the issue strongly with the Defence Minister and the three services as well as the Defence Ministry were on the same page on the issue, the sources said.

The MSP was first introduced by the 6th Pay Commission, accounting for compensation for intangible aspects of military service.

It accounts for a range of “hardships and disadvantages” which cannot be evaluated while assessing pay comparability.

The concept of MSP for armed forces personnel is widely prevalent in European countries.

The armed forces were pressing for a separate slab of MSP for JCOs and equivalent rank.

In November last year, the Army clarified JCOs are gazetted officers and cancelled a seven-year-old note describing them as “non-gazetted” officers.

The decision by the Army came amid growing resentment among a large section of its officers over the controversial issue of rank-parity between them and their civilian counterparts in the service headquarters.

We have already briefed you regarding our discussions held with the Member Staff, Railway Board, and other officials of the Railway Board, on 4th December, 2018, brief of the discussions held on 4th and 5th December, 2018, is also enclosed herewith:-

The Member Staff, Railway Board, had persistently requested us and also sent us a communication (Railway Board’s letter No.2018/E(LR)II/NM 1-9 dated 05.12.2018) in writing that the items raised by AIRF are under very active consideration of the Railway Board, but need some time, therefore, we should withdraw our call of “Work To Rule”, scheduled from 11th December, 2018.

After prolonged discussions, between the Railway Board as well as with the Zonal General Secretaries, and in consultation with the President AIRF, it has been decided that, the proposed call of “Work To Rule”, scheduled from 11th December, 2018, should be deferred for the time being and we should wait for some time for the outcome of the assurances given by the Railway Board.

I know that, all of you had worked round-the-clock for mobilizing the Railwaymen to prepare them for “Work To Rule”. Now, it has become more important to reach each and every Railwayman for thanking them for creating the tempo as well as we should also inform them about the assurances given by the Railway Board, based on the brief of 4-5 December, 2018, sent to you.

BRIEF OF THE MEETING HELD ON 4-5 DECEMBER, 2018 WITH THE MEMBER STAFF AND OTHER OFFICIALS IN RAILWAY BOARD

Implementation of four grade structure, in the ratio of 10:20:20:50, in the case of Trackmen/ Track Maintainers– Member Staff informed that, four grade structure, in the ratio of 10:20:20:50, is approved by the Full Board, and the file was put-up to Hon’ble MR for his approval. Hon’ble MR wanted certain clarifications from the Engineering Directorate, and the same has been submitted by the said Directorate for approval of Hon’ble MR.

Revision of the rates of Running Allowance and other Allowances related to Running Staff
– After lengthy discussions; the Member Staff informed that, the file is put-up to Hon’ble MR for his approval, and after his approval, the file would be sent to the MoF. It was informed by the Member Staff, Railway Board, that the concerning file is with Hon’ble MR for his approval.
Continuance of the LARSGESS – It was informed to AIRF that, the Railway Board have revisited the scheme, and the same will be submitted to Hon’ble Supreme Court in consultation with the Solicitor General, Government of India. Hon’ble Supreme Court has granted one-month time to the Railway Ministry for filing reply.
Advancement of prospects of the staff working in erstwhile GP Rs.1800 and GP Rs.4600- After prolonged discussions, Member Staff, Railway Board, agreed with the views of AIRF that, there is stagnation of the staff working in erstwhile GP Rs.1800. AIRF has suggested that 50% posts in GP Rs.1800 should be upgraded to GP Rs.1900 to provide advancement to the staff, so that, the benefit to the staff who is stagnated in GP Rs.1800 for a long period, can be extended. AIRF has also pointed out that, 10% posts of DR Quota in various categories should be converted into LDCE and promotional benefits should be given to the higher educated staff of various categories, including Track Maintainers. This should be in addition to LDCE Quota, already provided in the respective categories.
Non-revision of rates of Incentive Bonus/Bonus Factor and PCO Allowance paid to Technical Staff and Supervisors of the PUs and Maintenance Workshops– It was assured by the Railway Board that a concluded final proposal will be given to the Federation within a week, and a meeting to finalize the revised rates of Incentive Bonus/Bonus Factor will be called for soon.
Upgradation of the Apex level of Group `C’ to Group `B’ – AIRF insisted that, powers are vested with the Railway Board to grant upgradation for the apex grade Supervisors to Group `B’. This was also confirmed by the Finance Secretary(Exp.) on the previous occasion, and the minutes of the said meeting given to the Railway Board. In spite of that, the matter is dragged by the Railway Board by sending proposal to the MoF. The Federation(AIRF) insisted that, decision should be taken at the Railway Board level itself. Member Staff directed the AM(S) to put-up all the particulars, including the minutes of the meeting of the Standing Committee(JCM) for taking a decision as Railway Board primarily agreed to give Gazetted status to the Supervisors working in GP Rs.4800 and Rs.5400. The Federation(AIRF) insisted that, as per the Act and Codal Provisions as well as Transaction of Business Rules, the powers are vested in the Railway Ministry and they should not run to the DoP&T and MoF.
Regularization of the Act Apprentices in Railways– AIRF demanded that, all the Act Apprentices imparted training in the Railways should be absorbed in the Railways. It was explained to the Member Staff that the orders were available previously, but unfortunately, Board have issued orders on 20.06.2016 and implemented the orders with back date, depriving the Act Apprentices from the absorption in the Railways. The Federation demanded that, new Apprentices Act, passed by the Parliament, has given full powers to decide procedure for absorption of these Act Apprentices. Federation demanded that, Screening Type system should be adopted for absorption of the Act Apprentices. The Member Staff agreed to study the problem after finalization of the present RRC examination.

Engagement of the Act Apprentices in Railways – AIRF demanded that, the old practice, prevailing in various Workshops/Divisions, should be continued. The AM(Staff) assured to examine the issue and necessary instructions will be issued.

Restructuring of the IT Cadre– After prolonged discussions Board was agreed with the view of AIRF that restructuring should be carried out on the sanctioned strength and not on the role. Similarly, vacant posts in the cadre will not be freezed as was instructed in the earlier notification of restructuring of the cadre. The principle of “Financial Neutrality” will be adopted as followed in other cadre restructuring. It was also agreed that, looking the various aspects of GST, Digitalization and wide scope of the IT Cadre related solutions, there is a need of cadre strengthening of the IT Cadre over the Indian Railways.

NPS – The Board apprised that, earlier proposal sent by the Railway Board to the MoF was returned unapproved, giving example of the Paramilitary Forces as also huge strength of the Railwaymen. AIRF insisted that the proposal, reflecting the sensitive working of the Railwaymen, should again be sent to MoF, which was agreed to by the Official Side(Railway Board).

Quasi – After prolonged discussions Board agreed to re-examine the issue.

Hard Duty and Risk Allowance to various categories of staff– The Board apprised the Federation(AIRF) that, a comprehensive proposal, covering various Safety Categories, is under consolidation, as suggested by AIRF. The matter will be referred to the MoF later.

Duty Hours of Running and other Safety Categories Staff– After prolonged discussions, Member Staff apprised the Federation(AIRF) that the present recruitment process is in active mode and a panel is expected by the end of February 2019 or so, and thus the problem of the Running Staff as well as Safety Categories Staff will come to an ease since it is due to shortage of the staff because of no recruitments in past few years. On the demand of AIRF, the Member Staff agreed to send the roadmap for future recruitment. He also informed that, in future, all Group `C’ recruitments through RRB will be dealt by the Zonal Railways with their respective RRBs directly. He also conceded the demand of AIRF about delegating the powers for recruitment of the staff in GP Rs.1800 to the respective Zonal Railway Headquarters.

Headquarters/Outstation Rest of the Running Staff – AIRF strongly protested the unilateral withdrawal of the decision, arrived at after prolonged discussions in the PNM Meeting of AIRF with the Railway Board, without any consultation with the Federation. The Member Staff mentioned that, the compelling situation in detail will be provided to the Federation(AIRF), however, the matter will be looked into.

Attention is invited to this of!ice letter para 10 (i) and 10 (c) of Board’s letter No. E(NG)II/90/RC-1/117 dated 12.12.1990 wherein it had been laid down regarding order of priority in offering appointment on compassionate grounds.

Priority No. 10 (i) ~ Dependents of employees who die or are permanently crippled in the course of duty and 1 0 (c) – a time limit of one month should be observed within which appointment should be given and Para 6 of Board’s letter No. E(NG)II/91/RR-1120 dated 03.12.1991 wherein it had been laid down that Compassionate appointment in the clerical categories should be avoided to the extent possible. For any such appointment, General Manager should be personally satisfied that, the same is unavoidable, and offered as a last resort.

It has been decided by the Board that for the dependents of employees who die or are permanently crippled in the course of duty (Priority No.1), there should be no restriction on offering him/her clerical post and this power is hereby delegated to DRMs/CWMs solely for the dependents of employees who die or permanently crippled in the course of duty.

Attention is invited to Para 2018(c) of IREM Vol.I Reprint Edition 2019 and instructions issued vide Board's letter No. E(NG)I/2011/PM 1/5 dated 22.03.2011 regarding constitution of Selection Boards.

The aforesaid provisions have been reviewed by the Board with a view to eliminate avoidable delay in the selection process and further to the aforesaid provisions, it has been decided as under:

"In situation where eligible officers in specified grade are not available in the unit concerned for selection committee formation, shortfall may be made good with Senior Scale officers for selection to the posts carrying Grade Pay 4200 and above, and Junior Scale officers for selection to the posts carrying Grade Pay 2800 and below, subject to the condition that none of the members will be subordinate to any other memebr of the selection board."

The above provisions may be inserted as a Note below the existing para 218(c) of IREM Vol.I, 2009 Reprint Edition, replacing the existing note below this para as per ACS No. 258 enclosed herewith.

3. The APAR of NG staff in Level 6 (GP-4200) shall normally be finalized at JAG/SG/DyHoD level Officer.

4. Other guidelines issued from Board shall remain unchanged and be modified as and when required.

Sir/ Madam,

This is with reference to occurrence of frauds and its prevention in the process of payment of pension to pensioners in the field offices. It is suggested to take the actions as detailed below:

(i) Rotation policy of staff may be followed. The maximum tenure of three years may be followed in all Regional Offices without any exceptions. Records of charge allocation including deputing special messengers’ alongwith CD/BRS to the bank should be maintained and periodically verified by officer In-charge concerned.

(ii) Credit statement of uploaded data is being provided by the bank to the concerned EPFO office for reconciliation within a day. PPO wise reconciliation may be done by the system itself. The activity of reconciliation may be carried out under the supervision of RPFC induding credit in EPFO’s A/c No. 10 of undisbursed account.

(iii) All monthly/weekly pension payments to be validated from system (master-record of BRS) before finalizing disbursement scrolls. This will eliminate any chance of fraudulent pension payment at source (pension payment pension sanctioned).

Apart from the above actions the officer In-charge concerned should adopt all other measures as deems fit for prevention of fraud in pension payment.

In terms of Board's letter No. E(P&A)1-2016/RT~16, dated 20/09/2018 & 17/10/2018, doctors belonging to IRMS and Dental Doctors-under the Ministry of Railways has been provided opportunity to serve the Government upto 65 years under certain conditions on their exercising the option of posting to a clinical post.

G.S.R.370.— In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to the persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Fundamental Rules. 1922, namely:-

(1) These rules maybe called the Fundamental (Amendment) Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Fundamental Rules. 1922, in rule 22. in sub-rule (1), in clause (a). for sub-clause (I). the following subclause shall be substituted, namely:-

“(1) where a Government servant holding a post, other than a tenure post, in a substantive or temporary or officiating capacity is promoted or appointed in a substantive. temporary or officiating capacity, as the case may be, subject to the fulfillment of the eligibility conditions as prescribed in the relevant Recruitment Rules, to another post carrying duties and responsibilities of greater importance than those attaching to the post held by him, his initial pay in the time-scale shall be fixed by giving one increment in the level from which the Government servant is promoted and he or she shall be placed at a cell equal to the figure so arrived at in the level of the post to which promoted or appointed and if no such cell is available in the level to which promoted or appointed, he shall be placed at the next higher cell in that level.

Save in cases of appointment on deputation to an ex cadre post. or to a post on ad hoc basis or on direct recruitment basis, the Government servant shall have the option, to be exercised within one month from the date of promotion or appointment, as the case may be, to have the pay fixed under this rule from the date of such promotion or appointment or to have the pay fixed initially at the next higher cell in the level of the post to which he or she is promoted on regular basis and subsequently, on the date of accrual of next increment in the level of the post from which Government Servant is promoted, his pay shall be re-fixed and two increments (one accrued on account of annual Increment and the second accrued on account of promotion) shall be granted in the level from which the Government Servant is promoted and he or she shall be placed. at a cell equal to the figure so arrived, in the level of the post to which he or she is promoted; and if no such cell is available in the level to which he or she is promoted, he or she shall be placed at the next higher cell in that level.

In cases where an ad hoc promotion is followed by regular appointment without break, the option is admissible from the date of initial appointment or promotion. to he exercised within one month from the date of such regular appointment.

In cases where an officer has retired as ad hoc before being regularised to that post and later on has been assessed during the process of regularisation and found fit by the competent authority along with his or her juniors, who are still in service and are eligible to avail of the option facility from a date on which the retired employee was still in service, the same option facility shall also be extended to the retired employee, to be exercised within three months from the date when his or her junior became eligible to avail of option facility and in cases where such retired employee was himself the junior most, he or she may exercise the option facility within three months from the date when his or her immediate senior became eligible to avail of option facility:

Provided that where a Government servant is. immediately before his promotion or appointment on regular basis to a higher post, drawing pay at the maximum of the level of the lower post, his initial pay in the level of the higher post shall be fixed at the cell equal to the figure so arrived at in the level of the post to which promoted or appointed by increasing his pay in respect of the lower post held by him on regular basis by an amount equal to the last increment in the level of the lower post and if no such cell is available in the level to which he is promoted or appointed, he shall be placed at the next higher cell in that level.”

In a bonanza for government employees, the Cabinet Thursday raised the government's contribution to National Pension Scheme (NPS) to 14 per cent of basic salary from the current 10 per cent, sources said.

The Cabinet also approved tax incentives under 80C of the Income Tax Act for employees' contribution to the extent of 10 per cent, they added.

Presently, the government and employees contribute 10 per cent of basic salary each to NPS.

While the minimum employee contribution remains at 10 per cent, the government contribution has been increased from 10 per cent to 14 per cent.

 The Cabinet, headed by Prime Minister Narendra Modi, also allowed government employees to commute 60 per cent of the fund accumulated at the time of retirement, up from 40 per cent at present.

Also, employees will have the option to invest in either fixed income instruments or equities, sources said.

As per the Cabinet decision, if the employee decides not to commute any portion of the accumulated fund in NPS at the time of retirement and transfers 100 per cent to annuity scheme, then his pension would be more than 50 per cent of his last drawn pay, sources said.

The government did not announce the decision in view of the ensuing polls in Rajasthan Friday.

While the government is yet to decide on the date of notification of the new scheme, sources said such changes usually come into effect from the beginning of a financing year, meaning April 1, 2019.

This formula for changes in the NPS was worked out by the Finance Ministry based on the recommendation of a government-appointed committee.

सुत्रों के अनुसार गुरूवार को कैबिनेट ने सरकारी कर्मचारियों को लाभ देते हुए राष्ट्रीय पेंशन योजना (एनपीएस) में सरकारी अभिदान को वर्तमान के 10 प्रतिशत से बढ़ाकर मूल वेतन का 14 प्रतिशत कर दिया है।

सुत्रों का ये भी कहना है कि कैबिनेट ने आयकर की धारा 80सी तहत कर्मचारी कन्ट्रीब्यूशन के 10 प्रतिशत के लिए टैक्स प्रोत्साहन देने को भी कैबिनेट की मंजूरी दी गयी है।

वर्तमान में हरेक एन.पी.एस. के लिए सरकार और कर्मचारी मूल वेतन का 10 प्रतिशत का अभिदान दिया जा रहा है। जबकि न्यूनतम कर्मचारी कन्ट्रीब्यूशन 10 प्रतिशत रखा गया है और सरकार के कन्ट्रीब्यूशन को 10 प्रतिशत से 14 प्रतिशत तक बढ़ाया जा रहा है।

सूचना है कि प्रधानमंत्री नरेन्द्र मोदी की अध्यक्षता में कैबिनेट ने सरकारी कर्मचारियों को सेवानिवृति के समय एन.पी.एस. में जमा धन का 60 प्रतिशत तक की राशि कम्यूट करने की अनुमति को भी मंजूरी दी है जो कि अभी 40 प्रतिशत है।

इसके अतिरिक्त कर्मचारियों के पास यह विकल्प होगा कि वे अपने एन.पी.एस. फण्ड को या तो निश्चित आय के मद में या शेयर में निवेश कर सकते हैं।

कैबिनेट के निर्णय के अनुसार अगर कोई कर्मचारी सेवानिवृति के समय अपने एन.पी.एस. में जमा समेकित धन को किसी भी भाग को कम्यूट नहीं करने का निर्णय लेता है और शत प्रतिशत पेंशन योजना में स्था​नान्तरित करता है तो सुत्रों का कहना है कि उसका पेंशन उसके अंतिम वेतन के 50 प्रतिशत से भी ज्यादा हो सकता है।

सरकार द्वारा इस निर्णय की औपचारिक घोषणा शुक्रवार के राजस्थान के मतदान के कारण नहीं की गयी है।

ज​बकि सरकार द्वारा नयी योजना के अधिसूचना की तिथि पर विचार नहीं किया गया है सूत्रों का कहना है कि यह बदलाव वित्त वर्ष के प्रारंभ से लागू किया जा सकता है यानि 1 अप्रैल, 2019 से यह बदलाव लागू हो सकता है।

सरकार द्वारा गठित समिति की सिफारिशों आधार पर ही वित्त मंत्रालय द्वारा एन.पी.एस. में बदलाव के फार्मूले को लाया गया है।

Subject: Launching /Introduction of UPSC module in RRFAMS portal – reg.

The undersigned is directed to say that the RRFAMS portal has been in operation since 25.12.2016 for framing/amendment of Recruitment Rules by DOP&T.

The proposals received on this portal are scrutinized in DOP&T through online consultation with the user ministries/departments. Once the RRs become error free, approval of DOPT is conveyed through the system. Simultaneously, the Recruitment Rules are also frozen. Under the existing system after the RRs are frozen, the Ministries/Departments send the proposals along with necessary Annexure, hierarchy chart etc. in physical file to UPSC and DoLA.

2. As a next step towards achieving automation i.e. end-to-end processing and approval of RRs by the nodal Ministries, DOP&T in consultation with UPSC has now developed a module under RRFAMS for holding consultation with UPSC. In the new system after the RRs are approved and frozen by DOPT, the same shall be transmitted to UPSC and will be visible to Administrative Ministry/Department. The new system will be in operation w.e.f 03.12.2018 in test mode and will be formally pushed into service on 25.12.20 18. The comments/approval of UPSC will be conveyed through the system itself.

3. With the introduction of UPSC module, the requirement of sending proposal on physical files to UPSC after DOPT approval will be dispensed with.

4. In this regard it is also to say that some additional tabs have also been added at user end (Ministries/departments end) of the portal such as Information on Court cases, RRs of the promotional post etc for facilitating UPSC consultation. Therefore it is requested that the Administrative Ministry/Department, while initiating the proposal, may submit complete proposals by filling all the information’s sought to DOPT. Administrative Ministries/Departments are also requested to keep close watch on the RRFAMS portal regarding their proposals as the information regarding MR meeting, comments of UPSC etc will be conveyed through the RRFAMS portal w.e.f 25.12.2018.

Kindly refer to this office letter of even number dated 25-04/2012-PE-I dated 27.05.2016, on the subject mentioned above, wherein it was instructed that “these instructions will be effective from the date of issue of the orders. The actual benefit would, however, be admissible to the eligible officials from the date of actual promotion “.

2. However, vide this office letter of even number dated 10.11.2017, in para 4.5, it was clarified that “the promotion will be effective from the date of issue of the original order dated 27.05.2016 as per existing instructions on the subject. It will be applicable to all eligible officials including those who were in service but now retired”.

3. In this regard, this is to clarify further that these LSG, HSG-II, HSG-I and HSG-I (NFG) posts will be deemed to have been upgraded to these grades only w.e.f. the dates they are filled up, i.e. from the date the promoted official assumes the charge. Otherwise, the post will remain in the lower grade.

4. Hence, the instruction issued vide para 4.5 of letter dated 10.11.2017 stands modified accordingly.

सुप्रीम कोर्ट ने फैसला दिया है कि उच्चतर योग्यता रखने वाले उम्मीदवार को निचली योग्यता वाली पोस्ट पर आवेदन करने का अधिकार नहीं है. ऐसा वह तभी कर सकता है तब नियमों में यह कहा गया हो कि उच्च योग्यता वाले उम्मीदवारों में यह माना जा सकता है कि उनमें निचले स्तर की योग्यता होगी ही.

सुप्रीम कोर्ट ने कहा कि इस नियम के अभाव यह नहीं माना जा सकता कि उच्च योग्यता में आवश्यक रूप से निचली योग्यता होगी ही. योग्यता का मापदंड भर्ती की नीति से संबंधित है और राज्य सरकार एक नियोक्ता है. उसे अधिकार है कि वह किसी पद के लिए योग्यता की शर्तों का निर्धारण करे.

मामला जम्मू-कश्मीर के बिजली विभाग में टेक्निशियन- 3 के पदों का था. योगयता 10वीं के साथ आईटीआई मांगी गई थी. कुछ उम्मीदवारों के पास इलेक्ट्रिकल इंजीनियिरिंग में डिप्लोमा था लेकिन आईटीआई का प्रमाणपत्र नहीं था.

नरेंद्र मोदी सरकार का केंद्रीय कर्मचारियों के लिये नववर्ष का तोहफा कबूल नहीं है. NPS में सरकारी योगदान मूल वेतन का 14 प्रतिशत बढ़ोतरी नहीं पुरानी पेंशन चाहिए. सरकारी कर्मचारी संगठनो का राष्ट्रीय पेंशन प्रणाली के विरुद्ध आंदोलन तेज करने की धमकी.

एकबार फिर सरकारी कर्मचारियों की एकता सिर चढ़ के बोल रहा है. केंद्रीय कर्मचारियों को मोदी सरकार का तोहफा कबूल नहीं हैं. विभिन्न सरकारी कर्मचारी संगठनो ने इस आंदोलन को और तेज करने की धमकी दी है. उनका कहना है की राष्ट्रीय पेंशन प्रणाली (एनपीएस) में सरकार का योगदान बढ़ाकर मूल वेतन का 14 प्रतिशत कर नरेंद्र मोदी सरकार सरकारी कर्मचारियों को धोखा देना चाहती है.

गैरतलब है कि, नरेंद्र मोदी सरकार ने सरकारी कर्मचारियों के लिये गुरुवार को नववर्ष तोहफा का एलान किया है. मंत्रिमंडल ने राष्ट्रीय पेंशन प्रणाली (एनपीएस) में सरकार का योगदान बढ़ाकर मूल वेतन का 14 प्रतिशत कर दिया. जो फिलहाल 10 प्रतिशत है. हालांकि कर्मचारियों का न्यूनतम योगदान 10 प्रतिशत ही बना रहेगा. मंत्रिमंडल ने सरकारी कर्मचारियों के 10 प्रतिशत तक योगदान के लिए आयकर कानून की धारा 80 सी के तहत कर प्रोत्साहन को भी मंजूरी दी. फिलहाल सरकार और कर्मचारियों का योगदान एनपीएस में 10-10 प्रतिशत तक है.

इधर, विभिन्न सरकारी कर्मचारी संगठनो का स्पष्ट मानना है की सरकार का यह एलान केवल छलावा है, देश में मई-जून २०१९ में होने वाली लोकसभा चुनाव में भोट पाने का केवल एक हथकंडा है.

इन कर्मचारी संगठनो का दावा है कि सरकर जबतक राष्ट्रीय पेंशन प्रणाली (एनपीएस) को समाप्त कर पूरी तरह से पुरानी पेंशन योजना लागु नहीं करती तबतक वे अपनी मांग पर कायम रहेंगे. इनका कहना है की 26 नवंबर का असर दिखना शुरू हुआ है, कर्मचारी एकता यदि बनी रही तो वह दिन दूर नहीं जब यही सरकार बोलेगी की ओल्ड पेंशन लागू.

वहीँ, सरकारी कर्मचारियों का न्यूनतम योगदान 10 प्रतिशत पर बना रहेगा जबकि सरकार का NPS में सरकारी योगदान मूल वेतन का 10 प्रतिशत से बढ़ाकर 14 प्रतिशत किया गया है. प्रधानमंत्री मोदी की अध्यक्षता में केंद्रीय मंत्रिमंडल की बैठक में सरकारी कर्मचारियों को कुल कोष में से 60 प्रतिशत अंतरित करने को मंजूरी दी गई जो फिलहाल 40 प्रतिशत है. सूत्रों के अनुसार कर्मचारियों के पास निश्चित आय उत्पादों या शेयर इक्विटी में निवेश का विकल्प होगा.

मंत्रिमंडल के निर्णय के अनुसार यदि कर्मचारी सेवानिवृत्ति के समय एनपीएस में जमा धन का कोई भी हिस्सा निकालने का निर्णय नहीं करता है और 100 प्रतिशत पेंशन योजना में हस्तांतरित करता है तो उसका पेंशन अंतिम बार प्राप्त वेतन का 50 प्रतिशत से अधिक होगा. सूत्रों ने कहा कि सरकार को अभी नई योजना की अधिसूचना की तारीख के बारे में निर्णय करना है.

The undersigned is directed to refer to this Department’s O.M. No. 31011/5/2014-Estt.A-IV dated 24.09.2014, 23.09.2015 and 21.08.2017 on the procedure for booking of air tickets on LTC and to say that as per the extant instructions, whenever a Government servant claims LTC by air, he/she is required to book the air tickets directly from the airlines (Booking counters, website of airlines) or by utilizing the services of the authorized travel agents viz. ‘M/s Balmer Lawrie & Company’, ‘M/s Ashok Travels & Tours’ and ‘IRCTC’ (to the extent IRCTC is authorized as per DoPT O.M. No. 31011/6/2002-Est(A) dated 02.12.2009) while undertaking LTC journey(s).

2. In this regard, it is observed that despite reiterating the above instructions from time to time, this Department still continues to receive numerous references from various Ministries/Departments and individuals seeking relaxation for booking of air tickets for the purpose of LTC through private travel agents. In most of the cases, the common reasons cited by the Government employees are lack of awareness of the rules and work exigencies. 

3. Therefore, all the Ministries/Departments are advised to ensure wide circulation and strict compliance of the guidelines stated in para 1 of this OM. This point may also be emphasized by the Administration whenever any advance is sought or intention to avail LTC is conveyed by the Government servant. It is stated that henceforth only those cases, where it is established that bonafide mistake has occurred and the Administrative Ministry/Department is satisfied that undue hardship is being caused to the Government servant, shall be considered by this Department for relaxation provided that the information is received in the Proforma enclosed along with supporting documents.

The Administrative Ministry/Department needs to examine each case on the following parameters and where the Ministry/Department is satisfied that a bonafide mistake has occurred and undue hardship is being caused in any particular case, it may be sent to this Department in the following Proforma along with supporting documents:-

6.Whether the Govt. servant has availed of any tour package or other facility from the travel agent except the tickets?
7.The tickets may be checked for any additional, hidden or superfluous charges. If yes, the same shall not be admissible . ·
8.Government servant shall submit a self certification to his office/Administration that he has not availed of any tour package or any other facility from the travel agent except the tickets.

Streamlining of National Pension System (NPS)

Decision
The Union Cabinet in its Meeting on 6th December, 2018 has approved the following proposal for streamlining the National Pension System (NPS).

  • Enhancement of the mandatory contribution by the Central Government for its employees covered under NPS Tier-I from the existing 10% to 14%.
  • Providing freedom of choice for selection of Pension Funds and pattern of investment to central government employees.
  • Payment of compensation for non-deposit or delayed deposit of NPS contributions during 2004-2012.
  • Tax exemption limit for lump sum withdrawal on exit has been enhanced to 60%. With this, the entire withdrawal will now be exempt from income tax. (At present, 40% of the total accumulated corpus utilized for purchase of annuity is already tax exempted. Out of 60% of the accumulated corpus withdrawn by the NPS subscriber at the time of retirement, 40% is tax exempt and balance 20% is taxable.)
  • Contribution by the Government employees under Tier-II of NPS will now be covered under Section 80 C for deduction up to Rs. 1.50 lakh for the purpose of income tax at par with the other schemes such as General Provident Fund, Contributory Provident Fund, Employees Provident Fund and Public Provident Fund provided that there is a lock-in period of 3 years.

Background

The new entrants to the central government service on or after 01.01.2004 are covered under the National Pension System (NPS). The Seventh Pay Commission (7th CPC), during its deliberations, examined certain concerns regarding NPS and made recommendations in the year 2015. The 7th CPC recommended for setting up of a Committee of Secretaries in this regard. Accordingly, a Committee of Secretaries was constituted by the Government to suggest measures for streamlining the implementation of NPS in the year 2016. The Committee submitted its report in the year 2018. Accordingly, based on the recommendations of the Committee, draft Cabinet Note was placed before the Cabinet for its approval.

Implementation strategy and targets

The proposed changes to NPS would be made applicable immediately once time critical decisions are taken in consultation with the other concerned Ministries / Departments.

Major impact
  • Increase in the eventual accumulated corpus of all central government employees covered under NPS.
  • Greater pension payouts after retirement without any additional burden on the employee.
  • Freedom of choice for selection of Pension Funds and investment pattern to central government employees.
  • Benefit to approximately 18 lakh central government employees covered under NPS.
  • Augmenting old-age security in a time of rising life expectancy.
  • By making NPS more attractive, government will be facilitated in attracting and retaining the best talent.

Expenditure involved

The impact on the exchequer on this account is estimated to be to the tune of around Rs. 2840 crores for the financial year 2019-20, and will be in the nature of a recurring expenditure. The financial implications on account of provisions regarding payment of compensation for non-deposit or delayed deposit of NPS contributions during 2004-2012, would be in addition to the amount indicated above.

निर्णय
केन्‍द्रीय मंत्रिमंडल ने 6 दिसम्‍बर, 2018 को अपनी बैठक में राष्‍ट्रीय पेंशन प्रणाली (एनपीएस) को युक्तिसंगत या सरल बनाने के लिए निम्‍नलिखित प्रस्‍ताव को मंजूरी दी।
  • केन्‍द्र सरकार द्वारा एनपीएस टियर-। के दायरे में आने वाले अपने कर्मचारियों के लिए अपना अनिवार्य अंशदान मौजूदा 10 प्रतिशत से बढ़ाकर 14 प्रतिशत कर दिया गया है।
  • केन्‍द्र सरकार के कर्मचारियों को पेंशन फंडों और निवेश के स्‍वरूप के चयन की आजादी दी गई है।
  • वर्ष 2004-2012 के दौरान एनपीएस में अंशदान न करने या इसमें विलम्‍ब होने पर क्षतिपूर्ति की जाएगी।
  • एनपीएस से बाहर निकलने पर मिलने वाली एकमुश्‍त निकासी राशि पर कर छूट सीमा बढ़ाकर 60 प्रतिशत कर दी गई है। इसके साथ ही समूची निकासी राशि अब आयकर से मुक्‍त हो जाएगी। (मौजूदा समय में वार्षिकी की खरीद के लिए इस्‍तेमाल की गई कुल संचित राशि का 40 प्रतिशत कर मुक्‍त है। सेवानिवृत्ति के समय एनपीएस के सदस्‍य द्वारा निकाली जाने वाली संचित राशि के 60 प्रतिशत में से 40 प्रतिशत कर मुक्‍त है, जबकि शेष 20 प्रतिशत राशि कर योग्‍य है।)
  • एनपीएस के टियर-।। के तहत सरकारी कर्मचारियों द्वारा किये जाने वाला अंशदान अब आयकर की दृष्टि से 1.50 लाख रुपये तक की छूट के लिए धारा 80 सी के अंतर्गत कवर होगा। यह अन्‍य योजनाओं जैसे कि सामान्‍य भविष्‍य निधि, अंशकारी भविष्‍य निधि, कर्मचारी भविष्‍य निधि और सार्वजनिक भविष्‍य निधि के सम्‍तुलय है, बशर्तें कि इसमें तीन वर्षों की लॉक-इन अवधि हो।

पृष्‍ठभूमि

1 जनवरी, 2004 को अथवा उसके बाद केन्‍द्र सरकार की सेवा से जुड़ने वाले नये कर्मचारियों को राष्‍ट्रीय पेंशन प्रणाली (एनपीएस) के तहत कवर किया जाता है। 7वें वेतन आयोग ने वर्ष 2015 में अपने विचार विमर्श के दौरान एनपीएस से जुड़ी विशिष्‍ट चिंताओं पर गौर किया और सिफारिशें पेश कीं। 7वें वेतन आयोग ने इस संबंध में सचिवों की एक समिति गठित करने की सिफारिश की। तदनुसार, सरकार द्वारा वर्ष 2016 में सचिवों की एक समिति गठित की गई जिसे एनपीएस के कार्यान्‍वयन को युक्तिसंगत अथवा सरल बनाने के लिए विभिन्‍न उपाय सुझाने की जिम्‍मेदारी सौंपी गई। समिति ने वर्ष 2018 में अपनी रिपोर्ट पेश की। तदनुसार, समि‍ति की सिफारिशों के आधार पर मसौदा कैबिनेट नोट को मंजूरी के लिए कैबिनेट के विचारार्थ पेश किया गया।

कार्यान्‍वयन रणनीति और लक्ष्‍य

अन्‍य संबंधित मंत्रालयों / विभागों से सलाह-मशविरा करने के बाद महत्‍वपूर्ण निर्णय लिये जाने के पश्‍चात एनपीएस में प्रस्‍तावित बदलावों को तत्‍काल लागू कर दिया जायेगा।

प्रमुख प्रभाव
  • एनपीएस के दायरे में आने वाले केन्‍द्र सरकार के सभी कर्मचारियों की अंतिम संचित राशि में वृद्धि होगी।
  • कर्मचारियों पर कोई अतिरिक्‍त बोझ पड़े बगैर ही सेवानिवृत्ति के बाद उन्‍हें मिलने वाली पेंशन राशि बढ़ जायेगी।
  • केन्‍द्र सरकार के कर्मचारियों को पेंशन फंडों और निवेश के स्‍वरूप या रूपरेखा के चयन में आजादी मिलेगी।
  • एनपीएस के दायरे में आने वाले केन्‍द्र सरकार के लगभग 18 लाख कर्मचारी लाभान्वित होंगे।
  • जीवन प्रत्‍याशा बढ़ने की स्थिति में वृद्धावस्‍था सुरक्षा बढ़ जायेगी।
  • एनपीएस को और ज्‍यादा आकर्षक बनाने से सरकार को सर्वोत्‍तम प्रतिभाओं को आकर्षि‍त करने एवं उन्‍हें सेवा में बनाये रखने में आसानी होगी।

निहित व्‍यय
  • इस वजह से वित्‍त वर्ष 2019-20 के दौरान राजकोष पर लगभग 2840 करोड़ रुपये का भार पड़ने का अनुमान है और यह एक आवर्ती व्यय के रूप में होगा। वर्ष 2004-2012 के दौरान एनपीएस में अंशदान न करने या इसमें विलम्‍ब होने पर क्षतिपूर्ति किये जाने के प्रावधान के कारण जो वित्‍तीय भार पड़ेगा वह इस राशि के अतिरिक्‍त होगा।
लाभार्थियों की संख्‍या
राष्‍ट्रीय पेंशन प्रणाली को युक्तिसंगत बनाने से एनपीएस के दायरे में आने वाले केन्‍द्र सरकार के लगभग 18 लाख कर्मचारी लाभान्वित होंगे।

I am directed to say that as per extant instructions, non functional Grade Pay of Rs. 5400 in PB-2 (pre-revised) is granted to those Superitendents/ Appraisers who have completed 4 years of regular service in the Grade Pay of Rs. 4800/, Shri M. Subramaniam, the then Inspector who was granted Grade pay of Rs. 4800/- due to ACP scheme, got favorable judgement from the Hon’ble High Court of Madras and Civil Appeal No. 8883/2011 filed by UOI was dismissed by the Hon’ble Supreme Court. Review Petition in the said case was also dismissed by the Hon’ble Supreme Court.

2. Consequent upon dismissal of Civil Appeal No. 8883/2011 and Review Petition in Civil Appeal filed by UOI by Hon’ble Supreme Court, the judgement of Hon’ble High Court of Madras in M. Subramaniam has been implemented in consultation with D/o Expenditure.

3. Keeping in view a number of similar court cases in different Benches of CAT/Court being decided by CAT/High Court, in favour of petitioners, the matter was examined in the Board and a proposal was referred to D/o Expendiutre to consider extension of the benefit of the direction of the Hon’ble High Court in M. Subramaniam, to all similarly placed officers. Deptt.Of Expenditure vide note dated 12.11.2018 examined the matter and sought following clarifications:-

(i) How many individuals of which posts have been allowed the benefit so far?
(ii) How many similarly placed persons are to be covered in the benefit?
(iii) Whether the similarly placed persons are holder of the same post which was held by the individuals covered in the SLP?
(iv) The financial implications on the benefit already allowed and the estimated financial implication on the similarly placed employees?

    4. The details sought by D/o Expenditure vide note dated 12.11.2018 needs to be compiled from the Zonal Commissionerates. You are requested to kindly obtain the details/ information on the points mentioned above from Zonal Commissionerate, compile it and furnish the same to the Board for taking up the matter with D/o Expenditure. Since a number of court cases are pending in CAT/High Court, it is requested to expedite this exercise and detail/information be made available to the Board, by 20.12.2018.

    DISPLAY LIST OF ESM AND BENEFICIARIES AT POLYCLINICS AFTER RECEIPT' OF SMART CARDS AT STATION HEADQUARTERS

    1. The new 64 Kb ECHS Cards are received at Station HQs in respect. of their dependant polyclinics. At Station HQ's, the OIC, ECHS after checking each Card physically, acknowledges receipt online to respective Regional Centre and then forwards OTP to the beneficiary on his registered mobile number. 'Once the OTP is sent, the beneficiaries online application form also shows OTP sent and Card ready for collection. However, to further facilitate dissemination of information that. Cards are ready for collection, the competent authority has approved that a list of beneficiaries will be displayed polyclinic wise at the notice board of polyclinics whose Cards have been received at the Station HQ.

    2. In view of the above, Station HQ's are requested to download the list of beneficiaries when Cards are received at the Station HQ. A soft copy of the list, polyclinic wise be forwarded t.o respective polyclinics and at the polyclinic the OIC to a print out of the beneficiaries whose Cards are ready for collection at the Station Headquarters and display it on the notice board.
