EMPANELMENT OF HOSPITALS/NURSING HOMES AND DIAGNOSTIC CENTRES

1. Refer Govt of India, Min of Def letter No 228(03)/2017-WE/D(Res-I) dated 02 Jun 2017 (Copy enclosed and softcopy is also uploaded in ECHS website on (www.echs.gov.in).

2. Regional Centres will initiate action to complete the formalities required for empanelling hospitals approved for empanelment vide letter under reference. A Memorandum of Agreement (MoA) will be signed with each of the Hospital by the Director, Regional Centre ECHS concerned. The MoA will be made on Rs 100/- (Rupees one hundred only) non judicial stamp paper and will be valid for two years from the date of signing of the agreement. The payment for the stamp paper will be made by the empanelled facility. The following documents will be attached to MoA as Annexures:-

(a) Health facilities for which recognised. (Copy of Annexure of Govt letter pertaining to hosp).

(b) Negotiated Rates (only one rate per code No. as applicable to the medical facility will be mentioned and negotiated rated would be lower than CGHS rates).

3. Rates applicable will be as per prevalent CGHS rates/negotiated/existing hospitals rates whichever is lower (to be indicated by asterix).

Disposal of Application Forms and MoA

4. Application forms in respect of the Hospitals approved for empanelment by DoESW of MoD will be returned by the Central Organisation, ECHS to the Regional Centres concerned from where they originated.

5. The application forms will be stored in safe custody of Regional Centres. The application form will NOT be destroyed for two years after termination of the period of validity of the MoA.

6. The original and duplicate copies of MoA will be retained by the Regional Centres and the empanelled facility respectively. Additional photocopies of MoA alongwith Annexures including rates will be fonNarded/distributed as under:-

(a) Central Organisation ECHS.

(b) Concerned Area / Sub Area / Independent Sub Area.

(c) Concerned SEMOs.

(d) Concerned Polyclinics.

(e) Concerned CDAs.

7. Formal referrals to empanelled facilities as per laid down procedures can commence after signing of the MoA.

1. I am directed to state that in terms of the provisions of Govt of India, Ministry of Defence letter No. 22B(04)/2010/US(WE)D(Res) dated 18 Feb 2011 and 22B(02)/2013/US(WE)D(Res) dated 18 Oct 2013, it has now been decided by the 10th Screening Committee for empanelment of Medical facilities with ECHS in its meeting held on 10 Mar 2017 under the chairmanship of MD ECHS to empanel 189 Private Hospitals/Nursing Homes and Diagnostic Laboratories for different specialities and procedures as per the list attached in the Annexure:-

2. All the terms and conditions including fixation of rates payable to empanelled hospitals will be regulated under Govt of lndia, Ministry of Defence letter No228(O4)/2010/US(WE)/D(Res) dated 18 Feb 2011 and amended from time to time.

3. The rates for ECHS Hospital/Nursing Home, Dental Centres and Diagnostic Centres as approved by the Empowered Committee will be as per CGHS rates and will be notified by the Director, Regional Centre ECHS to all concerned including Polyclinics, SEMDs, CDA/PCDA and Central Organisation ECHS.

4. Empanelment of CGHS empanelled hospitals is subject to the hospital providing proof of its being a CG HS empanelled facility as on the date of signing MoA with ECHS.

5. CGHS empanelled medical facilities will be empanelled with ECHS for the period for which the facilities hold valid MoA with CGHS. The MoA will be extendable once CGHS renew the MoA with the medical facilities.

6. NABH accredited medical facilities will be empanelled with ECHS for the period of validity of NABH certificate and the MoA will be renewed once the medical facility is issued revalidation/renewed NABH certificate.

7. This issues with the concurrence of Ministry of Defence (Finance) vide their U.O. No. 34(05)/2010 dated 2.6.2017.

Dear Comrades,

As you are aware that for the last two years so many burning issues related to Postal, RMS and GDS employees are lying unsettled at the level of Directorate. We have discussed these issues several times with Secretary, Post and other higher officers of the Department in formal and informal meetings, but we are highly regretted to inform that there is no improvement in any matter.

NFPE Federal Executive Meeting held on 12.05.2017 has reviewed the whole situation in detail and after threadbare discussion, the following agitational programme has been decided for the below mentioned 10 points charter of Demand.

As per decision of Federal Executive we wanted to launch this agitational programme under banner of PJCA. We tried our best to convince the FNPO leadership to join but they are not agreed. So we have decided to launch the programme under banner of NFPE.

AGITATIONAL PROGRAMME

Phase- I – Mass Dharna in front of all Divisional offices.
Date - - 20.06.2017

Phase – II - Mass Dharna in front of all Circle/Regional offices.
Date – - 12.07.2017

Phase – III - Mass dharna in front of Postal Directorate, Dak Bhawan, New Delhi.
Date – - 26.07.2017

Phase IV - One day nationwide strike on 23.08.2017 (Formal notice of the strike will be served later.)

CHARTER OF DEMANDS:

1. Filling up of all vacant posts in all cadres of Department of Posts i.e. PA, SA, Postmen, Mailguard, Mailmen, Drivers and Artisans in MMS,MTS, PACO, PASBCO, Postal Accounts and GDS.

2. Implementation of positive recommendations of GDS committee Report. Grant of Civil Servant status to GDS.

3. Membership verification of GDS and declaration of result of regular employees membership verification.

4. Stop all types of harassment and victimization in the name of new schemes and technology induction and under contributory negligence factor and Trade Union victimization.

5. Payment of Revised wages and arrears to the casual, part-time, contingent employees and daily rated mazdoors as per 6th& 7th CPC and settle other issues of casual labourers.

6. Stop Privatization, Contractorization and outsourcing.

7. Implement Cadre Restructuring for left out categories i.e. RMS, MMS, PACO, PASBCO, Postmaster Cadre Postal Accounts etc. and accept the modifications suggested by Federation before implementation of cadre restructuring in Postal Group ‘C’.

8. Provision of CGHS facilities to Postal Pensioners also as recommended by 7th CPC.

9. Withdraw NPS (Contributory Pension Scheme). Guarantee 50% of last pay drawn as minimum pension.

10. Implement five days week working for operative staff in the Postal department.

NPS CONVENTION
A convention on New Pension Scheme is going to be held at Shah Auditorium Civil Lines New Delhi on 10th June – 2017 jointly under banner of Confederation & All India State Govt. Employees Federation. NFPE has allotted quota to all wings. All are requested to ensure cent percent participation in the convention.


GDS – MARCH TO COMMUNICATION MINISTER’S OFFICE
AIPEU Union – GDS has decided to organize GDS-March to communication Minister’s office – Sanchar Bhawan – New Delhi 27th July 2017. All Circle, Divisional and Branch Secretaries of NFPE Unions are requested to mobilize maximum no. of GDS in March and more employees should take past from nearby circles and Divisions to Delhi. All leadership of NFPE union should also take part in the march.

CASUAL LABOURER UNIONS PROGRAMMES
All India Postal, Casual, Part-time, Contingent workers Federation has decided the following programme of action.

1. Indefinite hunger fast in front of Chief PMG office Chennai from 27th June 2017.

2. All India Workshop on 13th August 2017 (Venue will be intimated later).

3. Massive Dharna in front of Dak Bhawan, New Delhi on 14th August 2017.

NFPE appeals to entire leadership to extend maximum co-operation and help to make the programmes of casual labourers union a grand success.

Sub: - Inordinate delay in settlement of the long pending problems faced by the Postal and RMS employees.
Sir,

For the last two years we have brought the following burning issues of the Postal and RMS employees including Gramin Dak Sevaks and Casual Labourers to the notice of the Directorate for amicable settlement. We have also discussed these cases several times with the administration in the formal meetings and informal meetings. Every time, it was assured that immediate action will be taken for early settlement of the issues raised by us. But we are sorry to state that other than repeated assurances, the things have not moved an inch forward and even now the situation is the same. As a result, most of the important issues raised by us remain unsettled and day-by-day more issues are getting accumulated. Employees at the lower level are the worst victims of this situation and their anger and discontentment is growing day-by-day. Unless immediate remedial measures are not taken to settle the issues in a time-bound manner through negotiation, the situation may go from bad to worse.

The following are the issues pending settlement at Directorate level.

1. Filling up of all vacant posts in all cadres of Department of Posts i.e. PA, SA, Postmen, Mailguard, Mailmen, Drivers and Artisans in MMS,MTS, PACO, PASBCO, Postal Accounts and GDS.

2. Implementation of positive recommendations of GDS committee Report. Grant of Civil Servant status to GDS.

3. Membership verification of GDS and declaration of result of regular employees membership verification.

4. Stop all types of harassment and victimization in the name of new schemes and technology induction and under contributory negligence factor and Trade Union victimization.

5. Payment of Revised wages and arrears to the casual, part-time, contingent employees and daily rated mazdoors as per 6th& 7th CPC and settle other issues of casual labourers.

6. Stop Privatization, Contractorization and outsourcing.

7. Implement cadre Restructuring for leftout categories i.e. RMS, MMS, PACO, PASBCO, Postmaster Cadre Postal Accounts etc. and accept the modifications suggested by Federation before implementation of cadre restructuring in Postal Group ‘C’.

8. Provision of CGHS facilities to Postal Pensioners also as recommended by 7th CPC.

9. Withdraw NPS (Contributory Pension Scheme). Guarantee 50% of last pay drawn as minimum pension.

10. Implement five days week working for operative staff in the Postal department.

As a responsible organisation, we have been extending full support and cooperation to the administration, in running the department in a most efficient manner and also for induction of high technology and increasing the revenue and productivity. But we regret to note that it has become a one-sided affair and the top level administration has failed to reciprocate the positive attitude shown by the employees.

The Federal Executive meeting of National Federation of Postal Employees which met at New Delhi on 12.05.2017 has viewed with grave concern the situation prevailing in the Department of Posts. The meeting has come to the inescapable conclusion that we can no longer be taken for granted by the administration, if the genuine and legitimate demands of the employees are not settled in a time bound manner through negotiations. The Federal Executive meeting further decided to organize following phased programme of action culminating in strike, for realization of the demands mentioned above.

Phase- I – Mass Dharna in front of all Divisional offices.
Date - - 20.06.2017

Phase – II - Mass Dharna in front of all Circle/Regional offices.
Date – - 12.07.2017

Phase – III - Mass dharna in front of Postal Directorate, Dak Bhawan, New Delhi.
Date – - 26.07.2017

Phase IV - One day nationwide strike on 23.08.2017 (Formal notice of the strike will be served later.)

We once again like to make it clear that we want to avoid a confrontation with the Administration and earnestly hope that the Secretary, Department of Posts, shall come forward for a negotiated settlement. On the other hand, we will be left with no alternative, but to go ahead with our agitational programmes as mentioned above.

आप सभी से अनुरोध है, कि प्रत्येक मंडल की हर शाखा के स्तर पर भारत सरकार की मजदूर विरोधी नीतियों, भत्तों पर बनी कमेटी की रिपोर्ट लागू करने में की जा रही देरी और आवास भत्तों में 3०%, 2०% और 10% में किसी भी कटौती के विरोध में जोरदार धरना/प्रदर्शन पर अपना पूरजोर विरोध प्रदर्शित करें और ​कृत कार्यवाही से केन्द्रीय कार्यालय को समय से अवगत कराये।

The 7th Central Pay commission in its recommendations have suggested that Pre-2016 pensioners should be compensated for the number of increments they were drawing in their retiring pay scale by giving 3% of basic pension per increment. This is a very beneficial step as far as pensioners are concerned because they will get increased pension. The increments in the retiring pay scale is earned as a result of a life time of service, 35 or 40 or more years of service in government posts.

The cabinet had generously accepted this recommendation of giving 3% per increment to the pensioners. Then one government official had pointed out that the necessary data for implementing this is not available. This is not true. all the relevant information of the pensioner is recorded and replicated in at least four places. In the original Pension Payment Order issued to the pensioner, in the head quarter of the office from which the pensioner had retired, the Central Pension Accounting Office, New Delhi and the Central Pension Processing Cell of the bank from which the pensioner gets the pension. An injustice is done to all the 52 lakh pensioners by denying them the benefit of the increments that they have earned by a life long service in Governement establishments. 

Hence it is requested that the Option 1 of the 7th CPC which takes into account the increments while fixing the pension be implemented and justice is done to the 52 lakhs Central Government Pensioners.

Ministry of Railways closes traffic on Dhanbad- Chandrapura section w.e.f 15-06-2017

Due to Jharia Coal Field Fire and acting on subsequent advisory received from Ministry of Coal, Ministry of Railways has decided to stop the operation of goods and passenger traffic on Dhanbad-Chandrapura Railway line w.e.f. 15.06.2017. Keeping in view the safety of passengers, Ministry of Railways has diverted 7 trains, cancelled 13 Mail Express Trains & 6 passenger trains.

Member Traffic, Railway Board Mohd Jamshed conducted a Press Conference in Rail Bhavan today to brief about this development. He informed that on an average 11 pairs of Mail/Express and 6 pairs of passenger trains run on the section daily. Special counters to facilitate refunds as per extant rules will be provided for the affected passengers. He reiterated that all efforts would be made to minimize passenger inconvenience. Reference: This HQrs Circular of even no dated 5.08.2016.

In continuation of this HQrs Circular cited above, a copy of Resolution bearing No. 1-2/2016-IC dated 16.05.2017 issued by Ministry of Finance/Department of Expenditure in continuation of Gazetted of India, notification dated 25.07.2016 is forwarded herewith.

2. Ministry of Finance(Department of Expenditure) vide their resolution dated 16.05.2017 has conveyed the acceptance of the Government to make the following changes in the recommendations of the 7th CPC in respect of the some categories of employees wherein point (4) and (5) is applicable to DAD establishment also-
Point (4):- the IOR of Level -13 of. civil pay matrix shall be enhanced from 2.57 to 2.67. Accordingly, the Civil Pay Matrix as contained in Annexure-I mentioned in para 6 of the aforesaid resolution dated 25th July 2016 shall be revised. The revised Civil Pay Matrix is enclosed as Appendix-I for reference.

Point (5):- the provision contained in para 13 of the aforesaid Resolution dated 25th July 2016 have been revised to the extent that the benefit of pay protection in the form of personal pay of officers posted on deputation under Central Staffing Scheme as envisaged therein , shall be given effect from 1st January 2016 instead of 25th July 2016. This benefit shall also be extended to officers from Services under Central staffing Scheme, coming on deputation to Central Government, on posts not covered under Central Staffing Scheme.

Subject: Implementation of Government’s decision on the recommendations of the 7th CPC- Revision of pension of pre-2016 pensioners/ family pensioners, etc.

Copy of Ministry of Personnel, PG & Pensions, Department of Pension & Pensioners’ Welfare OM No 38/37/2016-P&PW (A) dated 12-05-2017 containing Central Government decision for revision of pension of pre-2016 pensioners/family pensioners in accordance with first formulation recommended by the 7th CPC is forwarded herewith for information and necessary action.

2. As per para 4 of DOPP&W ibid OM, the pension/family pension w.e.f. 01-01-2016 in respect of all pensioners/family pensioners, who retired/died prior to 01-01-2016, may be revised by notionally fixing their pay in the pay matrix recommended by the 7th CPC in the level corresponding to the pay in the pay scale/pay band an grade pay at which they retired/ died. This will be done by notional pay fixation under each intervening Pay Commission based on the formula for revision of pay. While fixing pay on notional basis, the pay fixation formulae approved by the Government and other relevant instructions on the subject in force at the relevant time shall be strictly followed. As per first formulation recommended by 7th CPC and accepted by the Government the revised pension/family pension w.e.f. 01-01-2016 shall be calculated based on this notionally revised pay.

3. In this regard reference is also invited to DOPP&W OM No 45/86/97-P&PW (A) (iii) dated 10-02-1998 issuing instructions for revision of pension/family pension in respect of Government servants who retired/ died before 01-01-1986, by notional fixation of their pay in the scale of pay introduced w.e.f. 01-01-1986. For the purpose of calculation of notional pay w.e.f. 01-01-2016 of those Government servants who retired or died before 01-01-1986, the pay scale and notional pay as on 01-01-1986, as arrived at in terms of the instructions issued vide DOPP&W OM No 45/86/97-P&PW (A) (iii) dated 10-02-1998, will be treated as the pay scale and the pay of the concerned Government servant as on 01-01-1986. In the case of those Government servants who retired or died on or after 01-01-1986 but before 01-01-2016, the actual pay and the pay scale from which they retired or died would be taken into consideration for the purpose of calculation of the notional pay as on 01-01-2016 in accordance with para 2 above.

4. For the purpose of revision of pension /family pension as elaborated above in terms of Department of Pension & Pensioners’ Welfare OM No 38/37/2016-P&PW (A) dated 12-05-2017, revised LPC-cum-data sheet audited by the last Pay & Accounts Office of the concerned Government servant would have to be forwarded to PCDA (P) Allahabad by the concerned unit/formation. Accordingly, any subsidiary instructions to meet the audit requirements in connection with the submission of requisite documents for the approval of revised LPC may please be issued to the units and formations through Command/Area Headquarters. The implementation instructions in this regard are also being finalized by PCDA (P) and will be circulated to all Heads of Offices shortly.

5. To have an effective monitoring of the notional revision of pay as on 01-01-2016 in terms of DOPP&W OM No 38/37/2016-P&PW (A) dated 12-05-2017 and approval of revised LPC-cum-datasheet for forwarding to PCDA (P) Allahabad, it is requested that a monthly report in the format enclosed may please be forwarded to HQrs Office. The first report on this account showing the position as on 30-06-2017 may please be submitted to reach HQrs office by 07th July 2017.

REVISION OF PENSION IN RESPECT OF PENSIONERS OF CENTRAL GOVERNMENT AUTONOMOUS BODIES

Department of Pension & Pensioners Welfare, Government of India, has clarified as follows —–

“DOP&PW has issued orders for revision of pension under the 7th CPC for Central Civilian employees/pensioners. The decision in regard to revision of pension in respect of employees/pensioners of Autonomous bodies is required to be taken by the Administrative Ministries/Departments. The Department of Pension & Pensioner’s Welfare had not issued any orders for revision of pension of pensioners/retirees of autonomous bodies in the past also.

Similarly this Department does no issue Dearness Relief (DR) orders for pensioners who retired from Central Autonomous bodies.”

EXTENDING THE BENEFIT OF PENSION REVISION TO THE EMPLOYEES AND OFFICERS WHO ARE ABSORBED IN THE CENTRAL PUBLIC SECTOR UNDERTAKINGS – LATEST POSITION

Department of Pension and Pensioner’s Welfare has issued OM No. 38/37/2016 – P&PW (A) (ii) dated 04.08.2016 regarding implementations of the Seventh Central Pay Commission – Revision of Pension of Pre-2016 pensioners and Family Pensioners etc. In para 7 (a) of aforesaid OM, it was mentioned that –

“Where the Government servants on permanent absorption in public sector undertakings/Autonomous bodies continue to draw pension separately from the government, the pension of such absorbees will be updated in terms of these orders. In cases where the Government servants have drawn one time lump-sum terminal benefits equal to 100% of their pensions and have become entitled to the restoration of one-third commuted portion of pension as per the instructions issued by this Department from time to time, their cases will not be covered by these orders. Orders for regulating pension of such pensioners will be issued separately.”

In the orders dated 10.09.2016 of Hon’ble Supreme Court in Civil Appeal No. 6048/2010 Shri K. Ganesan Vs Union of India, it was mentioned that —-

“Having heard learned Counsel for the appellants, and having persued the record of the case, we find no justification whatsoever to interfere with the impugned order, directing restoration of 2/3rd in respect of the respondent herein, after expiry of the requisite period of commutations. The instant appeal is accordingly dismissed.”

In the same order dated 01.09.2016 of Hon’ble Supreme Court in Civil Appeal No. 6371 of 2010 Shri K. L. Dhall & Anr Vs Union of India, it is stated that —-

“Heard Learned casual for the rival parties. In view of the dismissal of Civil Appeal No. 6048 of 2010 by us today (Union of India and another Vs K. After consultation with Department of Expenditure and Department of Legal affairs, two Review Petitions have been filed by the Government in the Hon’ble Supreme Court vide Review Petitions No. 465/2017 and Review Petition 472/2017 against the order dated 01.03.2016 of Hon’ble Supreme Court in Civil Appeal No. 6048/2010 (Shri K. Ganesan Vs Union of India) and Civil Appeal No. 6371 of 2010 (Shri. K. L. Dhall & Anr Vs. Union of India). The Review petition came up for hearing in the Hon’ble Supreme Court on 22.03.2017. The Hon’ble Supreme Court has dismissed both the Review Petition vide order 22nd March 2017.

Government has now informed that since, the above orders dated 01.09.2010 of Hon’ble Supreme Court has a bearing on the question of revision of one-third restored pension of the absorbed pensioners, no orders for the revision of one-third pension in such cases could be issued so far. The matter would be examined in the light of dismissal of the Review Petitions mentioned above.

OFFICE MEMORANDUM

Subject: Recommendations of the 7th Central Pay Commission — bunching of stages in the revised pay structure under Central Civil Services (Revised Pay) Rules, 2016.

With reference to the subject mentioned above and in continuation of this Department's OM of even number dated 07.09.2016, the undersigned is directed to inform that, a large number of references have been received from Ministries/Departments seeking clarifications relating to the application of the benefit on account of bunching of stages while fixing the pay in the revised pay structure.

2. It has also been brought to the notice of this Department that some offices have extended the benefits on account of bunching based on subjective interpretation of the provisions of OM dated 07.09.2016, which may not be consistent with the principles and philosophy of the 7th CPC recommendations on bunching. Implementation of such pay fixation orders are not in conformity with the 7th CPC principles on bunching and may create further anomalies. In order to ensure consistency of approach in applying the provisions relating to bunching and to address the queries on various aspects of bunching, it has been decided to issue detailed guidelines on bunching.

3. All Ministries/Departments are, therefore, advised that the implementation of the provisions on bunching in OM dated 07.09.2016 may be put on hold till the time the detailed instructions in this regard are issued by Department of Expenditure. It is also requested that if orders on account of bunching have already been issued by Ministries/Departments but not implemented, the same may not be given effect to.

WAGE REVISION – SECOND ROUND
EXCHANGE OF CHARTER OF DEMANDS.

As you aware that the owners are anxious to settle the wage revision which is due from 1.11.2017, and to achieve this goal there were communications to the Bank managements time and again. Prior to Nationwide strike exclusively by Bankmen on 28th Feb, 2017, officers’ organisations had submitted the broad summary on 20/02/2017 to IBA. Following the submission, at Chennai, on 19th April, 2017, a meeting was held, in which, Com.Alok Khare, Com. M.A.Srinivasan, Com. V.Ramabhadran , Com.G.Gunasekaran and the undersigned participated in the exercise. It was the past practice to submit the Charter of demands of officers and workmen together, but, on 2nd May, 2017, it was not possible.

In the meanwhile, to fine tune the COD, once again, a meeting was held on 1/06/2017 at INBOC office at MUMBAI, in which Com. Alok Khare, Com. V.Viswanathan and the undersigned participated.

IBA has invited the negotiating unions for a discussion today at IBA office to take the wage talks further. Chairman of the IBA Negotiating Team, Shri.R.K.Thakkar, (UCO) Smt. Usha Ananthasubramanian, (Allahabad Bank), Shri.Prashant Kumar (SBI), Shri.V.G.Kannan, CEO IBA, Shri.Rajkumar Dy.CEO, Shri.K.S.Chauhan Vice President HR & IR, besides the members of HR Dept of IBA. CEO, IBA initiated the proceedings of the meeting and handed over the forum to Chairman, Negotiating Team, for taking the discussion further.

After the exchange of the CODs by Officers and Workmen organisations with IBA and the IBA handing their list of demands, Chairman Negotiating team expressed that the time line mentioned in the earlier meeting should be kept in mind, present health of Industry and also the negotiations for officers shall be restricted upto Scale III. He further placed the periodicity of meeting will be every month. While supplementing the views of IBA, Smt. Usha Ananthasubramanian, emphasised that there should be a forward movement at the conclusion of the every meeting.

Reacting to the observations made, representatives have expressed that the expectations of the workforce should be fully addressed, de-stressing of the workforce should be carried out, health of the industry is not on account of the wage cost, negotiations cannot be restricted upto Scale III, residual issues of last wage revision exercise to be resolved viz., Regulated working hours, Discipline and Appeal Regulations, Accountability Policy, 5 days a week, issues of retirees- record note, officer representatives in the Banks’ boards, comparison of wages with Pay commission, unilateral introduction of service condition by a bank, Number of representatives to be allowed to participate in the negotiation, protection from cyber-crime, and problems encountered by the employees in the Insurance backed hospitalisation scheme etc. The meeting lasted for nearly an hour. The representative of the Officers’ organisations have handed over a letter addressed to Chairman IBA pertaining to the restriction stipulated by IBA.

MANAGEMENT ISSUES:
[1] C2C concept to be brought in; 
[2] Rationalisation of Special Pay carrying posts. 
[3] Review of the two graduation increments; 
[4] Transfer and deployment of workmen staff; 
[5] Simultaneous conduct of departmental and judicial proceedings for workmen; 
[6] Conducting the departmental proceedings after retirement of workmen; 
[7] Premature retirement of workmen; 
[8] Outsourcing of any activity within the RBI guidelines; 
[9] Review of the automatic movement of officers from Scale I to II and also Scale II to III ; 
[10] To mark lien on NPS fund of employees to recover loss to the Bank on account of their proved misconduct.

UFBU meet-Post discussion with IBA: Subsequently, the representatives of nine unions met and discussed the issues confronting the Industry as well as the collective approach on the wage revision. The meeting lasted for nearly 90 minutes with the decision to meet on a mutually convenient day for a detailed discussion to chalk out the future course of action to “Save the Banking Industry” and also “halt the attacks on jobs and job Security”.

Awaiting for the forward movement for a collective, consensus and also achievable plan of action.

Subject: Online generation and recording of Annual Performance Assessment Report (APAR) on SPARROW (Smart Performance Appraisal Report Recording Window) for all Organised Group 'A' services - Extension of timelines for completion of APAR for the year 2016-17.

As all the Cadre Controlling Authorities of Organised Group 'A' Services are aware that it has been decided to implement online generation and recording of Annual Performance Assessment Report (APAR) of officers under their cadre from the reporting year 2016-17, through SPARROW platform.

2. Some of the Cadre Controlling Authorities have intimated practical difficulties in switching over from manual to online mode of recording of APARs. In view of this, the cadre authorities have expressed apprehensions that target dates prescribed in DoPT O.M.No.21011/02/2009-Estt.(A) dated 23rd July, 2009 may not be met and have requested for extension of timelines.

3. The matter has been examined in this Department and it has been decided that the target dates prescribed in O.M. dated 23rd July, 2009 be relaxed as one time measure only for online generation, filling up self-appraisal, reporting, reviewing and acceptance of APAR for the year 2016-17 through SPARROW portal. The revised target dates for recording of APAR online for the year 2016-17 is enclosed as Annexure. This relaxation is subject to the condition that no remarks shall be recorded in the APAR for the year 2016-17 after 31.12.2017. Where the reporting, reviewing and the accepting authority fail to record their comments within the time frame, the officer may be assessed on the basis of the overall record and self-assessment for the year, if he has submitted his self-assessment within stipulated time.

It has been decided that the holidays as specified in the Annexure -I to this OM. will be observed in all the Administrative Offices of the Central Government located at Delhi/ New Delhi during the year 2018. In addition, each employee will also be allowed to avail himself / herself of any two holidays to be chosen by him / her out of the list of Restricted Holidays in Annexure - II.

2. Central Government Administrative Offices located outside Delhi / New Delhi shall observe the following holidays compulsorily in addition to three holidays as per para 3.1 below:

3.1. In addition to the above 14 Compulsory holidays mentioned in para 2, three holidays shall be decided from the list indicated below by the Central Government Employees Welfare Coordination Committee in the State Capitals, if necessary, in consultation with Coordination Committees at other places in the State. The final list applicable uniformly to all Central Government offices within the concerned State shall be notified accordingly and no change can be carried out thereafter. It is also clarified that no change is permissible in regard to festivals and dates as indicated.

3.2 No substitute holiday should be allowed if any of the festival holidays initially declared subsequently happens to fall on a weekly off or any other non-working day or in the event of more than one festivals falling on the same day.

4. The list of Restricted Holidays appended to this O.M. is meant for Central Government Offices located in Delhi / New Delhi. The Coordination Committees at the State Capitals may draw up separate list of Restricted Holidays keeping in View the occasions of local importance but the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are to be included in the list of restricted holidays.

5.1 For offices in Delhi / New Delhi, any change in the date of holidays in respect of Idu’l Fitr, Idu’l Zuha, Muharram and Id-e-Milad, if necessary, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions after ascertaining the position from the Govt. of NCT of Delhi (DCP, Special Branch, Delhi Police).

5.2 For offices outside Delhi / New Delhi, the Central Government Employees Welfare Coordination Committees at the State Capitals are authorised to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in respect of Idu’l Fitr, ldu’l Zuha, Muharram and Id-e-Milad.

5.8 It may happen that the change of date of the above occasions has to be declared at a very short notice. In such a situation, announcement could be made through P.I.B/T.V. /A.I.R. / Newspapers and the Heads of Department / Offices of the Central Government may take action according to such an announcement without waiting for a formal order, about the change of date.

6. During 2018, Diwali (Deepavali) falls on Thursday, October 19, 2017 (Ashvina 28). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on “Narakachaturdasi Day”. In view of this, there is no objection if holiday on account of Deepavali is observed on “Naraka Chaturdasi Day (in place of Deepavali Day) for the Central Government Offices in a State if in that State that day alone is declared as a compulsory holiday for Diwali for the offices of the State Government.

7. Central Government Organisations which include industrial, commercial and trading establishments would observe upto 16 holidays in a year including three national holidays viz. Republic Day, Independence Day and Mahatma Gandhi’s birthday, as compulsory holidays. The remaining holidays / occasions may be determined by such establishments/ organisations themselves for the year 2018, subject to para 3.2 above.

8. Union Territory Administrations shall decide the list of holidays in terms of Instructions issued in this regard by the Ministry of Home Affairs.

9. In respect of Indian Missions abroad, the number of holidays may be notified in accordance With the instructions contained in this Department’s O.M. No.12/5/2002-JCA dated 17th December, 2002. In other words, they will have the option to select 16(Sixteen) holidays of their own only after including in the list, three National Holidays and Idu’l Fitr, in the list of compulsory holidays with the Idu’l Fitr falling on day of weekly off (Saturday).

10. In respect of Banks, the holidays shall be regulated in terms of the extant instructions issued by the Department of Financial Services, Ministry of Finance.

Retiring Employees Can Check their PPO Status online

The facility of checking the PPO Status and pension service is available online on  Web Responsive Pensioners’ Service.  Central Government Employees, who are retiring and whose pension papers are submitted on "Bhavishya" Application, now can check their PPO Status online.  "Bhavishya" is now mandatory.

Pension Processing Status Tracking : Retired and retiring pensioners can track status of their pension cases of both new as well as revision like date of receipt of their cases in CPAO and date sent from CPAO to the Bank. To track the pension status, in respect of retired government employees, PPO numbers, date of birth and date of retirement/date of death are required. For retiring employees, PAN number and date of retirement is required.

Subject:- Problems being faced by the pensioners / family pensioners regarding credit of pension amount into their Bank Accounts.

Attention is invited to CPAO's OM NO. CPAO/Tech/Bank Performance/2015-16/60 dated-14.06.2016 for better pensioner services by banks and minimize grievances/complaints from pensioners related to pension payments. Inspite of issuing frequent instructions, number of representations are received from pensioners/family pensioners experiencing difficulties relating to delays and incorrect amount of pension being credited in their bank accounts. The pensioners have also complained about the recovery of excess amount from their bank accounts.

All measures should be taken for efficient pension delivery to avoid such grievances and Heads of CPPCs and Heads of Govt. Business Divisions are again requested to provide monthly pension slips alongwith break up to pensioners/ family pensioners and invariably at the time of commencement of pension and thereafter whenever there is change in quantum of pension.

This issues with the approval of the competent authority.

NOTIFICATION

New Delhi, the 15th June, 2017

G.S.R. 592(E).— In exercise of the powers conferred by the proviso to article 309 of the Constitution and clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules to amend the Central Civil Services (Revised Pay) Rules, 2016, namely:—

1.(1) These rules may be called the Central Civil Services (Revised Pay) (Amendment) Rules, 2017.

(2)They shall be deemed to have come into force on the 1st day of January, 2016.

2.In the Central Civil Services (Revised Pay) Rules, 2016,—

(a)in rule 3, in clause (v), for the figures “2006”,  the figures “2016” shall be substituted ;

(b)in rule 12, for the words “the date of notification of these rules.”, the following shall be substituted, namely:—

“1 st January, 2016 and the same shall apply to the pay of officers coming on deputation to posts in the Central Government which are not covered under the Central Staffing Scheme.”;

(c)in the Schedule,—

(i)for PART A, the following PART shall be substituted, namely;—

  • Seventy per-cent of such earmarked posts should be filled up through promotion from Grade Pay 4600;
  • Thirty per-cent should be filled up through a Limited Departmental Competitive Examination in which employees from both Grade Pay 4200 and Grade Pay 4600 would be eligible to compete. This will enable deserving and meritorious employees at Grade Pay 4200 to jump Grade Pay 4600 and go directly to Grade Pay 4800 [level 8].
iii. Eighty per-cent of the employees in Grade Pay 4800, will be eligible for non-functional upgrade to level 9 [Grade Pay 5400 (Pay Bands-2)] upon completion of four years in level 8, on a seniority-cum-suitability basis.”
