Dear sir,

Refund of overpayment of pension to the Government Account – Recovery of excess/wrong pension payments made to the pensioners


Please refer to out circular DGBA.GAD.NO.H-10450/45.03.001/2008-09 dated June 1, 2009 on the above subject advising that whenever any excess payment of government pension is detected, the entire amount should be credited to the government account immediately.

2. It is hereby clarified that the above instructions contained therein presume an act of omission on the part of the agency bank. On the other hand, if the agency bank is of the view that the excess/wrong payment to the pensioner is due to errors committed by the government, they may take up the matter with full particulars of the cases with respective Government Department for a quick resolution of the matter. However, this must be a time bound exercise, and the government authority’s acknowledgement to this effect must be kept on the bank’s record. The banks may take up such cases with government departments without reference to the Reserve Bank of India.

3. In all other cases, where the excess payment has arisen on account of mistakes committed by the bank, the amount paid in excess should be credited back to government account in lump sum immediately, as advised in the circular referred to above.

Minimum wage for central govt employees may be hiked

Union representatives meet Arun Jaitley, Rajnath Singh and Suresh Prabhu, demanding increase in minimum monthly pay beyond Rs18,000 suggested by Seventh Pay Commission

New Delhi: Under pressure from the unions, the government has indicated that it may increase the minimum monthly pay of central government employees beyond the Rs.18,000 suggested by the Seventh Pay Commission, seeking to defuse a strike threat.

The assurance has divided several government unions on whether to go ahead with the indefinite strike starting 11 July.

Three cabinet ministers—finance minister Arun Jaitley, home minister Rajnath Singh and railway minister Suresh Prabhu—met representatives of several government staff unions late on Thursday for almost two hours and assured them that their demand would be looked into.


The unions have been demanding Rs.26,000, higher than the Rs.18,000 approved by the cabinet on Wednesday on the Seventh Pay Commission’s report. The government said it was more than doubling minimum pay from Rs.7,000 after accepting the recommendations of the commission, which would put an extra Rs.1.02 trillion in the hands of 10 million government employees and pensioners.

“Three top ministers called us and we met at Rajnath Singh’s house for two hours till 11pm last night. We have been assured that the minimum wage issue is going to be referred to one of two committees that the government is setting up to rectify any anomalies in the pay commission recommendations’ implementation,” said Shiva Gopal Mishra, general secretary of the National Joint Council of Action (NJCA), a confederation of several government staff unions.

The council claims a membership of 3.3 million, including workers of Indian Railways, the country’s largest employer.

Mishra said Jaitley accepted their concern. “He said the government will try to rectify some of our demands, including minimum wage,” the NJCA general secretary said.

Union leaders claimed that the pay commission’s recommendation and the government’s announcement raising minimum pay from Rs.7,000 to Rs.18,000 had glossed over the fine print.

“Now, base pay plus dearness allowance (DA) makes the minimum wage Rs.15,700. They have increased it to Rs.18,000,” said K.K.N. Kutty, national president of the Confederation of Central Government Employees and Workers.

“When you are doing away with DA in the new system, the hike cannot be just Rs.2,000,” said C. Srikumar, general secretary of the All India Defence Employees Federation, a union of civilian workers in factories and establishments under the ministry of defence.

Mishra said the home minister assured them that “their interaction with us has the blessings of PM Narendra Modi”.

“On minimum wage, we are for a negotiated settlement and it seems there is some consideration at the highest level,” he added.

An office-bearer at an employees’ union said the government’s offer had posed a dilemma to union leaders, noting that it wasn’t a written assurance, “without which it will be tough to accept that the government is indeed serious in reworking the minimum wage”.

The offer had ended up dividing the unions on whether to proceed with the strike, this person said on condition of anonymity. “And we could not reach a conclusion on Friday on our next course of action,” he said, adding that the railway workers’ union was hesitant about going on strike.

Mishra, who is also the general secretary of All India Railwaymen’s Federation, sounded a conciliatory note.

“We are fighting for the welfare of our own workers…a strike is an option if government does not listen to us. There seems to be a political willingness to solve what we are demanding and that’s what was indicated last night,” Mishra told reporters in New Delhi.

On Friday, NJCA wrote to all unions that “government has proposed to refer the issue of minimum wage and fitment formula (for calculation of salary) to a committee for reconsideration. The NJCA will await communication in this regard from the government”.

It said that it will meet on 6 July again to decide on the proposed strike.

What is interesting is that increasing the minimum pay will change the salary fitment calculations. If the minimum wage is hiked from Rs.18,000 to even Rs.20,000, the fitment rate will be higher than the 2.57 times approved by the government based on the pay commission recommendations.

“If the 2.57 fitment formula is tinkered with, then salary and pension in general for all segments of employees will go up, putting further stress on the exchequer. So the government has to walk a fine balance and a lot of homework is required,” said a government official, who declined to be named.

The acceptance of the pay commission recommendations is a potential boost to the consumer economy.

A further hike could lift consumption further, but it will be tough on government finances, the official said.

Rating agency India Ratings and Research Pvt. Ltd said the gross impact of pay hike on the economy is likely to be Rs.94,775 crore.

“The central government will receive income tax on this payout and collect excise duty on consumption, after sharing the increase in income tax and excise duty with states. Thus the net impact on the central government finances is estimated to be Rs.80,641 crore,” said D.K. Pant, chief economist of India Ratings and Research.

Doctors Demand Revision Of 7th Pay Commission Recommendations

New Delhi:  Central and state doctors on Thursday observed 'Black Badge Day' demanding revision of the 7th Pay Commission recommendations.

Besides, central government doctors under the banner of Joint Action Council of Service Doctor Organisation (JACSDO) and state government doctors under All India Federation of Government Doctors' Association (AIFGDA), resident doctors under banner of FORDA (Federation of Resident Doctors Association) also joined the protest.

"It has become farcical on part of central government to increase the retirement age of doctors while making the job and salary conditions highly unattractive. This will most certainly lead to massive exodus of experienced doctors towards private sector or even abroad.



"At a time when the Finance Minister has cited the IIM report to justify employees' salary, why is the government turning a blind eye towards the same IIM report that states that doctors are highly underpaid in the government sector.

"Despite repeated meetings and assurances given by various ministers, including the Health Minister and the Finance Minister, the final reports of the 7th CPC have dealt a massive shock to the medical fraternity," JACSDO member Shabarish Dharampal said.

"When the 7th CPC was constituted we doctors were very hopeful that our demands will be looked after, which is increasing Non-Practising Allowance (NPA) to 40 per cent from existent 25 per cent, instead it has been reduced to 20 per cent.

"The basic pay and NPA were merged together while calculating House Rental Allowance (HRA) earlier, but this has now been omitted and HRA will be calculated only with basic pay resulting in less than the desired salary," said FORDA President Pankaj Solanki.

The doctor's body also demanded uniform pay scales, night shift allowances which currently exist for nursing staff in government hospitals and the formulation of a uniform central residency scheme for the resident doctors of India.

JACSDO represents 11 organised and unorganised Central Health Services (CHS), Indian Railway Medical Services (IRMS), Indian Ordinance Health Services (IOHS), MCD, NDMC, Delhi administration and ESIC.

सातवें वेतन आयोग में सुधार को लेकर यूनियन के हड़ताल वापसी के संकेत की खबर नवभारत टाईम्स ने प्रकाशित की है:-

केंद्रीय गृह, वित्त और रेल मंत्रियों के साथ सरकारी कर्मचारियों की विभिन्न यूनियनों की बैठक के बाद अब यह संकेत मिलने लगे हैं कि सरकारी कर्मचारी अपनी हड़ताल वापस ले लेंगे। रेलवे यूनियन भी अब हड़ताल पर न जाने के लिए सहमत हैं। अब ये यूनियन चाहती हैं कि केंद्रीय मंत्रियों के साथ हुई बैठक में जो वादा किया गया है, उसे लिखित में सार्वजनिक कर दिया जाए। इस बीच सरकार के प्रस्ताव के बाद सरकारी कर्मचारियों के संगठन एनजेसी की 6 जुलाई को बैठक बुलाई गई है।


मोदी थे गंभीर :सरकारी सूत्रों के मुताबिक केंद्र सरकार के कर्मचारियों की हड़ताल के नोटिस को खुद प्रधानमंत्री नरेन्द्र मोदी ने ही गंभीरता से लिया था। वह नहीं चाहते थे कि किसी तरह की हड़ताल हो। इसी वजह से उन्होंने बृहस्पतिवार को गृहमंत्री राजनाथ सिंह, वित्तमंत्री अरुण जेटली और रेलमंत्री सुरेश प्रभु को निर्देश दिए थे कि वे यूनियन प्रतिनिधियों से बातचीत करके इस मसले को सुलझाएं। दरअसल खुद प्रधानमंत्री 6 जुलाई से विदेश दौरे पर जा रहे हैं। ऐसे में वह चाहते थे कि उनके रवाना होने से पहले ही हड़ताल समाप्ति का ऐलान हो जाए।

केंद्रीय मंत्रियों से बातचीत :इन निर्देशों के बाद ही बृहस्पतिवार रात को यूनियन नेताओं की केंद्रीय मंत्रियों से बातचीत हुई थी। इस बातचीत के दौरान सरकार ने यूनियनों की न्यूनतम वेतन बढ़ाने की मांग को लेकर एक कमिटी के गठन का प्रस्ताव दिया है। यह कमिटी एक तय अवधि में रिपोर्ट देगी।

वार्ता की अच्छी पहल : इंडियन रेलवे की फेडरेशन के महासचिव और सरकारी कर्मचारियों की विभिन्न यूनियनों के संगठन के संयोजक शिवगोपाल मिश्र ने इस बैठक की बात स्वीकार करते हुए कहा है कि सरकार की ओर से बातचीत की अच्छी पहल हुई है। मंत्रियों ने इस बातचीत के जरिए माहौल बनाया है पर हड़ताल खत्म करने पर उन्होंने कहा कि 6 जुलाई को यूनियनों के संगठन की बैठक बुलाई गई है। इसमें हड़ताल पर अंतिम फैसला लिया जाएगा।

7वें वेतन आयोग से नाखुश 33 लाख केंद्रीय कर्मचारी, बुधवार को तय करेंगे 11 जुलाई की प्रस्तावित हड़ताल पर अपना रूख

नई दिल्ली। केंद्रीय कर्मचारियों के संगठनों की संयुक्त संघर्ष परिषद (एनजेसीए) वेतन के मुद्दे पर सरकार के साथ हाल की बातचीत के मद्देनजर 11 जुलाई को प्रस्तावित हड़ताल करने या न करने का निर्णय बुधवार को करेगी। लगभग 33 लाख केंद्रीय कर्मचारियों का प्रतिनिधित्व करने वाली एनजेसीए ने सातवें वेतन आयोग की सिफारिशों के आधार पर लागू वेतन वृद्धि को बहुत कम बताया है। मंत्रिमंडल ने पिछले सप्ताह वेतन आयोग की सिफारिश को लागू करने का निर्णय लिया। इसके तहत न्यूनतम वेतन 18,000 रुपए तय किया गया है पर कर्मचारी इसे कम बता कर इसका विरोध कर रहे हैं।



एनजेसीए के संयोजक शिवगोपाल मिश्र ने कहा, सरकार ने एनजेसीए के साथ बातचीत शुरू की है। हम इसका स्वागत करते हैं। लेकिन हड़ताल पर जाने के बारे में निर्णय छह जुलाई को परिषद की बैठक में किया जाएगा। एनजेसीए के प्रतिनिधियों ने 30 जून को वित्त मंत्री अरूण जेटली, गृहमंत्री राजनाथ सिंह, रेल मंत्री सुरेश प्रभु तथा रेल राज्यमंत्री मनोज सिन्हा के साथ बैठक की थी। बैठक में मिश्र भी शामिल थे। उन्होंने कहा, उन्होंने हमें कुछ भी आश्वासन नहीं दिया। उन्होंने न्यूनतम वेतन और फिटमेंट फार्मूला पुनर्विचार के लिये एक समिति को भेजने का फैसला किया है। समिति तीन से चार महीने में अपनी रिपोर्ट दे सकती है। सरकार की तरफ से एनजेसीए की मांग पर ध्यान देने के बाद ऐसी अटकलें हैं कि 11 जुलाई से अनिश्चितकालीन हड़ताल को टाला जा सकता है। एनजेसीए न्यूनतम वेतन 18,000 रुपए से बढ़ाकर 25,000 रुपए से अधिक करने की मांग कर रही है।

सरकार ने फिटमेंट फार्मूले के तहत मौजूदा न्यूनतम वेतन 7,000 रुपए में 2.57 गुना की वृद्धि की है। इसके आधार पर न्यूनतम वेतन 18,000 रुपए हो गया है। पर कर्मचारी फिटमैंट फार्मूला 3.68 की मांग कर रहे हैं। इससे न्यूनतम मासिक वेतन 25,760 रुपए हो जाएगा। एनजेसीए कान्फेडरेशन ऑफ सेंट्रल गवर्नमेंट इंप्लायज (सीसीजीई), ऑल इंडिया डिफेंस इंप्लाय फेडरेशन, ऑल इंडिया रेलवे मेन फेडरेशन और नेशनल कार्डिनेशन कमेटी ऑफ पेंशनर्स एसोसिएशन समेत सरकारी कर्मचारी संगठनों का संयुक्त मंच है।

G.S.R. . . .....(E) In exercise of the powers conferred by sub-section of (4) of section 3 of the Public Provident Fund Act 1968 (23 of 1968), the Central Government hereby makes the following scheme further to amend the Public Provident Fund Scheme, 1968, namely:-


1. (1) This Scheme may be called Public Provident Fund (Amendment) Scheme, 2016.

(2) It shall come into force on the date of its publication in the Official Gazette

2. In the Public Provident Fund Scheme, 1968, in Paragraph 9. for sub-rule 3(C). the following sub-paragraph shall be substituted, namely-

"(3C) A subscriber shall he allowed premature closure of his account or the account of a minor of whom he is the guardian. on a written application to the Accounts Office, on any of the following grounds namely:-

(i) that the amount is required for the treatment of serious ailments or like threatening diseases of the account holder. spouse or dependent children or parents. on production or supporting documents from competent medical authority,

(ii) that the amount 8 required for higher education of the account holder or the minor account holder. on production of documents and fee bills in confirmation of admission in a recognised institute of higher education in India or abroad:

Provided that such premature closure shall be allowed only after the account has completed five financial years.

Provided further that premature closure under this sub-paragraph shall be subject to deduction of such amount which shall be equivalent to one percent less interest on the interest rates as applicable from time to time in the table payable on the deposits held in the account from the date of opening of the account till the date of such premature closure. calculates in accordance with the sample calculation as shown in the table on next page:

Subject: Seeking Nominations/applications for the National Child Awards for Exceptional achievement - reg.

The undersigned is directed to say that this Ministry has instituted National Child Awards for Exceptional achievement, to give due recognition to children with exceptional abilities and who have achieved outstanding status in various fields including academics, arts, culture, design and sports etc. A copy of the guidelines is enclosed. The salient features of the award is given below


(1) National Child Awards for Exceptional achievement 2016

The award is to be given to the children with excellence in the field of (i) Innovation in any field including design, (ii) Scholastic achievements at National level (e.g. first position in mathematics in two successive years, (iii) Sports, (iv) Arts, (v) Culture, (vi) Social Service, (vii) Music, (viii) Any other field which deserves recognition as per the decision of the Central/National Selection Committee. Children residing in India of or above the age of 5 years and not exceeding 18 years (as on 31st July of respective years) are eligible. There will be 36 National Awards (equivalent to the number of States/UTs). There will be one gold medal, a cash prize of Rs. 20,000/-, Book vouchers of Rs. 10,000/- , a certificate and a citation and 35 silver medals, a cash prize of Rs. 10,000/- each, book vouchers of Rs. 3,000/- each, a certificate and a citation will be given. However, not more than two candidates shall be awarded from one State/UT under this scheme. The last date for receipt of
applications/ nominations is 31.08.2016.

2. You are requested to forward nominations/applications from your Ministry/Department of suitable children in the proforma for the above mentioned awards to this Ministry. 

3. You are requested to to the time limit mentioned in the awards so as to enable this ministry to make timely selections for conferment of awards.

Revised Guidelines
NATIONAL CHILD AWARD FOR EXCEPTIONAL ACHIEVEMENT
INTRODUCTION

The Government of India from time to time has been instituting awards for individuals and organizations who have done outstanding work for the welfare and development of children.

2. The Ministry instituted the Awards in 1996 to give recognition to children with exceptional abilities and who have achieved outstanding status in various fields including academics, arts, culture, design and sports etc. The revised guidelines are as follows

3. The Award will be known as “NATIONAL CHILD AWARD FOR EXCEPTIONAL ACHIEVEMENT”. The achievement should be recognized/sponsored by an independent agency/authority in the concerned field. The achievement should not be one-off, but carried out over a period of time. There should be some indication that the child can continue with the activity for some time.

4. ELIGIBILITY CRITERIA

(a) Children residing in India of or above the age of (+5) years and not exceeding 18 years (as on 31st July of respective year).

(b) Excellence in any one of the following fields
(Achievements that benefit society will be encouraged)

(i) Innovation in any field including design. 
(ii) Scholastic achievements at national level (e. g. first position in mathematics in two successive years)
(iii) Sports
(iv) Arts
(iv) Culture
(v) Social service
(vi) Music
(viii) Any other field which deserves recognition as per the decision of the Central/National Selection Committee.

5. THE AWARD

There will be 36 National Awards for the child with exceptional achievement i.e. one gold and 35 silver (equivalent to the number of States/UTs in the country). However, not more than two candidates shall be awarded from one State/U T. The Awards for the child with exceptional achievement shall consist of:- 

A. Gold Medal (20 grams) 1 (One)
  • Gold Medal - (20 grams),
  • Award money of Rs. 20,000/~ (Rupees twenty thousand only),
  • Book vouchers of Rs. 10,000/- (Rupees ten thousand only),
  • A certificate and a citation.


B. Silver Medals (50 grams each) - 35 (Thirty five)
  • Silver Medal (50 grams) for each awardee,
  • Award money @ Rs. 10,000/- for each awardee,
  • Book vouchers of Rs. 3,000/- (Rupees three thousand only),
  • A certificate and a citation.


The Child will receive the Award personally.

6. SELECTION COMMITTEE

A Central/National Selection Committee will make the selection out of the cases recommended by various bodies. The composition of the Selection Committee shall be as under:

1. Minister In-charge of Ministry Women & Child Development - Chairperson
2. Secretary, Ministry of Women & Child Deve1opment - Member
3. Secretary or his nominee in the M/o Social Justice & Empowerment - Member
4. Secretary or his nominee in the Dept. of School Education & Literacy- Member
5. Secretary or his nominee in the Dept. of Culture - Member
6. Secretary or his nominee in the Ministry of Youth Affairs & Sports - Member
7. Secretary or his nominee in the Ministry of Science & Technology Member
8. Joint Secretary (Child Welfare), Ministry of Women & Child Development .Member Secretary

7. RECOMMENDING AUTHORITIES

The application should be recommended by State Government/U T Administrations, Central Ministries/Departments/PSUs/Autonomous Bodies/ Statutory Organizations of the Government of India, Principal of School and reputed voluntary organizations working in the field of Child Welfare & Protection.

Recommendations will include the photograph of the child, the names of the parent(s), Aadhar number and full contact details. Related achievements may be judged from bio-data and other related materials and photographs submitted by the applicant. Special consideration may be given to the physical/ mental standard of the candidates while selecting. They should include a short (not more than 75 words) write-up on why the recommending authority feels that the child is eligible and suitable for an award.

8. DATE OF RECEIPT OF RECOMMENDATION

Particulars of the child recommended for the award should be furnished in the Proforma given at Annexure. Recommendation received after 31St August may not be considered by the Selection Committee.

The Central Selection Committee shall finalise their recommendations by 30th September every year.

9. Publicity:

State Governments/UT Administrations may release suitable advertisement in the local newspapers well in advance and incentives in the form of Appreciation Certificate may be considered for the NGOs for searching best entries. Special mention may be made in the meetings about the National Award scheme and the facilities to be provided to participants.

10. Date of Award
The Awards will be announced on 14th November each year and will be given away in New Delhi on a convenient date.

11. Arrangements for the Award

Arrangements for the lodging and boarding of the awardees shall be made by the Ministry of Women and Child Development. The Awardees as also his/her parents or guardians (maximum two numbers excluding awardee) will be reimbursed AC-2 Tier Railway fare or actual expenses incurred on this account, whichever is less. Local awardees will be entitled for local transport as per Government Rules as may be amended from time to time.

The undersigned is directed to say that while giving his opinion dated 04.04.2016 in case of Shri V. K. Vashisth of Cabinet Secretariat, the Ld. SG Shri Ranjit Kumar has advised to file an application for clarification in Sukhdev Singh's judgment dated 23.04.2013 (Civil Appeal No. 5892/2006, Supreme Court of India) before the Hon'ble Supreme Court of India on whether the circular [OM No. 21011/1/2010-Estt. (A) dated 13.04.2010 of DoP&T] and the judgment would be treated as prospective and not retrospective qua communication of the Annual Confidential Report of every kind. In this regard, the Cabinet Secretariat has sought information with all facts and figures in numbers including the likely chaos in the number of cases due to retrospective effect of the above said OM and judgment. 

2. In view of above all administrative authorities are requested to give details of cases, if any arose or likely to be arisen in their Ministry/Department/Office and their consequent implications like requirement of conducting Review DPCs, revisiting of seniorities, re-fixation of pay, revisions of pension etc. In this regard, number of representations and CATs/Courts cases, if any filed by the officials/officers (including retired officials/officers) may also be intimated to this Department.

राष्ट्रपति की बेसिक सैलरी से ज्यादा नहीं हो सकती है किसी सरकारी कर्मचारी की तनख्वाह - एक कानूनी विवाद  और 9 लोगों को मिलेगी पीएम-राष्ट्रपति से भी ज्यादा सैलरी
नोएडा। सातवें वेतन आयोग की सिफारिशें लागू होने के बाद 2.50 लाख रुपए की मासिक तनख्वाह को लेकर कानूनी विवाद सामने आया है। आयोग की सिफारिशें लागू होने के बाद केंद्रीय कैबिनेट सेक्रेटरी और सेना अध्यक्ष जैसे कई उच्च पद वाले अधिकारियों को भारत के राष्ट्रपति की बेसिक सैलरी 1 लाख रुपए ज्यादा हो गई है, जबकि नियम ये है कि भारत में प्रथम नागरिक यानी राष्ट्रपति से ज्यादा किसी भी सरकारी अफसर की बेसिक सेलरी नहीं हो सकती है।


रिटायर्ड अधिकारी पीके मिश्रा का कहना है कि इस मामले में केवल अपवाद के तौर पर नियामक संस्थाओं के अफसरों को ही छूट मिलेगी। मौजूदा समय में राष्ट्रपति की मौजूदा बेसिक सैलरी 1.50 लाख रुपए है। ऐसा पहली बार हुआ है कि कैबिनेट सेक्रेटरी राष्ट्रपति की बेसिक सेलरी 1 लाख रुपए से ज्यादा सेलरी उठाएंगे। इस मामले में वित्त सचिव ने बताया कि यह सच है कि सातवें वेतन आयोग की सिफारिशें लागू होने के बाद कुछ उच्च अधिकारियों की बेसिक तनख्वाह महामहिम की बेसिक सेलरी से ज्यादा हो गई है। जानकारों का कहना है कि कानून के मुताबित किसी सरकारी अधिकारी की सेलरी राष्ट्रपति से ज्यादा नहीं होना चाहिए था। इस समस्या के निदान के लिए केंद्र सरकार इस मामले में जल्द ही नोटिफिकेशन निकालेगी। गौरतलब है कि सातवें वेतन आयोग की सिफारिशों के आधार पर कैबिनेट सेक्रेटरी, कैग, सेना प्रमुख जैसे उच्च अधिकारियों की बेसिक सेलरी को 90 हजार से बढ़ाकर 2.50 लाख रुपए कर दिया गया है। यह राष्ट्रपति के बेसिक सेलरी से 1 लाख रुपए ज्यादा है।

जानकारों के मुताबिक इस मामले में सरकार के पास अब जो विकल्प हैं, वो इस प्रकार हैं

1. सरकार कैबिनेट सेक्रेटरी और अन्य उच्च अधिकारियों की सेलरी घटाकर राष्ट्रपति की बेसिक सेलरी से कम करे, लेकिन इस बात की संभावना कम है।

2. सरकार राष्ट्रपति की बेसिक सेलरी को बढ़ाकर 2.50 लाख रुपए से ज्यादा करे और इसे 1 जनवरी 2016 की बीते तारीख से लागू किया जाए। [Patrika]

4.5 लाख रुपए प्रतिमाह होगा वेतन

नोएडा। वेतन आयोग की सिफारिशों को कैबिनेट से मंजूरी मिल चुकी है। जल्द ही बढ़ा हुआ पैसा सभी वेतन और पेंशनभोगियों के खाते में पहुंच जाएगा, लेकिन क्या आप जानते हैं कि वेतन आयोग के बाद देश में नौ लोग ऐसे भी होंगे जिनका वेतन देश में सबसे ज्यादा होगा। आज तक ऐसा नहीं था, लेकिन 7वां वेतन आयोग लागू होने के बाद अब ऐसा होने जा रहा है।

ये मिलेगा लाभ

हमारे देश में नौ नियामक संस्थाएं काम करती हैं। 7वें वेतन आयोग ने सिफारिश की है कि देश की नौ नियामक संस्था के चेयरमैन को सबसे ज्यादा वेतन दिया जाए। इसके साथ ही इन नियामक संस्था के सदस्यों को भी मोटा वेतन दिया जाएगा। बता दें कि वेतन आयोग ने तय किया है कि इन नियामक संस्था के चेयरमैन को 4.5 लाख रुपए प्रतिमाह का वेतन दिया जाएगा। साथ ही सदस्यों को चार लाख रुपए का वेतन देना तय किया गया है। इसके साथ ही इनके वेतन में 25 फीसदी की बढ़त और डीए में 50 फीसदी की बढ़त की सिफारिश है।

नई दिल्ली। सेवंथ पे कमीशन को मंजूरी मिलने के साथ ही देशकोर्ट जज, जस्टिस अशोक कुमार माथुर से भास्कर के नवल सक्सेना और मुकुल सिंघवी ने हुई ख़ास बातचीत इंटरव्यू में एक बात भी निकल कर आई कि लोग इम्प्लॉइज की सैलरी न बढ़ाने को लेकर कमीशन को चिट्ठिभर में सेंट्रल गवर्नमेंट इम्प्लॉइज की सैलरी में बढ़ोतरी की चर्चा है इसी बीच कमीशन के प्रेसिडेंट व पूर्व सुप्रीम यां भी लिखते थे पढ़िए किस प्रश्न को लेकर जवाब में जस्टिस माथुर ने कहा, रेलवे इम्प्लॉइज का काम देखना है तो ट्रेन में आज भी साफ चद्दर नहीं मिलती...


इंटरव्यू के दौरान किये गए सवाल निम्न प्रकार है-

Q.-क्या भत्तों को लेकर सिफारिशाें में कोई विसंगति है जो सरकार लागू नहीं कर पाई है?
A.-सरकार पर वेतन बढ़ोतरी से ही एक लाख करोड़ से ज्यादा का बोझ आ गया है भत्तों से यह और बढ़ेगा शायद सरकार सिफारिशों को एक बार और जांचना चाहती हो इसीलिए एक कमेटी बनाकर चार महीने का समय लिया है।

Q- सरकार का कहना है कि वेतन वृद्धि से मांग बढ़ेगी, अर्थव्यवस्था में तेजी आएगी, लेकिन महंगाई नहीं बढ़ेगी यह कैसे संभव है?
A- राजनीति मैं नहीं समझता हां, महंगाई तो बढ़ेगी ही आप सैलरी ग्रोथ अनाउंसमेंट से पहले यानी 28 जून और आज के भावों की ही तुलना कर लीजिए पता चल जाएगा महंगाई बढ़ी या नहीं इसका फायदा सवा करोड़ सरकारी कर्मचारियों को हो रहा है, इसका रिजल्ट महंगाई के रूप में सवा सौ करोड़ जनता को भुगतना होगा।

Q- 88 भत्तों को समाप्त करने और प्रेरणा भत्ते जैसे नए भट्टों को जोड़ने का क्या मतलब? जब अच्छी सैलरी है तो प्रेरणा के लिए पैसा क्यों?
A-साइकिल, हेयर कटिंग, फरलो जैसे भत्तों को हमने समाप्त करने की बात की है इनमें कई तो ऐसे हैं, जिनमें 50 पैसे से एक रुपए तक भत्ता था वहीं नए भत्ते परफॉर्मेंस आधारित हैं, जो अच्छा काम करेगा, उसे मोटिवेशन अलाउंस मिलेगा।

Q-वेतन तो बढ़ गया लेकिन कर्मचारियों की जवाबदेही के लिए क्या सिफारिशें की गईं?
A-हमने सिफारिश की है कि अब सिर्फ अच्छा करने से काम नहीं चलेगा कर्मचारी-अधिकारी बहुत अच्छा काम करें तभी वेतन वृद्धि और प्रमोशन (एमईसीपी) मिले अब रुटीन में यानी सिर्फ साल पूरे कर लेने पर न तो वेतन वृद्धि हो और न प्रमोशन 20 साल तक जो कर्मचारी प्रमोशन के लायक नहीं पाया गया, उसे घर बैठाओ ओवरटाइम का पैसा भी समाप्त करने का सुझाव हमने दिया।

Q-नियम सख्त किए, इससे सक्षम कर्मचारियों को नुकसान नहीं होगा?
A-त्रिवेदी कमेटी ने स्टडी कर इम्प्लॉइज के लिए लक्ष्य तक तय किए थे, लेकिन यह कुछ विभागों में ही लागू हुए कुछ ने तो अब तक नहीं अपनाया हमने टारगेट पूरे करने वालों के लिए कई तरह के इंसेंटिव की सिफारिश की है इसमें व्यक्तिगत, सामूहिक या विभागीय इंसेंटिव शामिल हैं।

Q-सियाचिन में सैन्य अधिकारी को हार्ड ड्यूटी अलाउंस 31 हजार रु. और पूर्वोत्तर में आईएएस अधिकारी को 61 हजार रु., विसंगति क्यों?
A-पूर्वोत्तर के आईएएस से ऐसी तुलना उचित्त नहीं है वहां विकास अभी-अभी शुरू हुआ है कोई अधिकारी वहां जाना नहीं चाहता था, ऐसे में आईएएस को अतिरिक्त फायदे दिए गए हैं इसी का परिणाम आज विकास के रूप में देखा जा सकता है दूसरी ओर सेना को हार्ड ड्यूटी के साथ, रिस्क अलाउंस, एमएसपी (मिलिट्री सर्विस पे) जैसे अन्य फायदे भी तो मिल ही रहे हैं वैसे हमने सेना के अफसर, जवान व नर्स के भत्ते बढ़ाने की सिफारिश भी की है।

Sub: Change of date of holiday on account of Id-ul-Fitr during 2016 for all Central Government administrative offices located at Delhi / New Delhi. 



As per list of holidays circulated vide this Ministry's 0.M.No.12 / 7 / 2015-JCA-2 dated the 11th June, 2015, the holiday on account of Id-ul-Fitr falls on Wednesday the 6th July, 2016. It has been brought to notice of this Ministry that in Delhi Id-ul-Fitr will be celebrated on 7th July, 2016. Accordingly, it has been decided to shift the Id-ul-Fitr holiday to 7th July, 2016 in place of 6th July, 2016 as notified earlier, for all Central Government administrative offices at Delhi / New Delhi.

2. For Offices outside Delhi / New he not Delhi are Employees functioning) Coordination Committees or Head of Offices (where such Committees are not functioning) can decide the date depending upon the decision of the concerned State Government.

Cabinet approves redevelopment of seven GPRA colonies in Delhi

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has approved redevelopment of seven General Pool Residential Accommodation (GPRA) colonies i.e. Sarojini Nagar, Netaji Nagar, Nauroji Nagar through National Buildings Construction Corporation Limited (NBCC) and Kasturba Nagar, Thyagraj Nagar, Srinivaspuri and Mohammadpur through Central Public Works Department (CPWD) to replace the existing housing stock of 12,970 dwelling units of Type I to IV with Build Up Area (BUA) of approx. 7.49 lakh sqm with approx. 25,667 dwelling units of Type II to VI with BUA of approx. 29.18 lakh sqm. with supporting social infrastructure facilities.



The project will also develop Government office accommodation for nearly 2.42 lakh sqm at Netaji Nagar.

The total estimated cost of the project is Rs.32,835 crores including maintenance and operation costs for 30 years. The project shall be implemented on self-financing basis by sale of commercial BUA in Nauroji Nagar and parts of Sarojini Nagar, adjoining the Ring Road.

The project will be completed in five years in a phased manner.

Background:

At present there is shortage of Government accommodation in National Capital Region. This leads to Government officials waiting for eligible housing. Thus, Ministry of Urban Development has moved a proposal for redevelopment of existing old dilapidated housing colonies to augment the housing stock by making optimum utilization of land resources as per Master Plan Delhi (MPD) - 2021 and using modern construction technology with green building norms and in-house solid / liquid waste management facilities.

Cabinet approves Revision of pension of BSNL Pensioners Removing Anomalies

The Union Cabinet chaired by the Prime Minister Shri Narendra Modi has approved the revision of pension of BSNL pensioners and family pensioners, who retired prior to 10.06.2013 by allowing the benefit of merger of 50% DA/DR with Basic Pay/ Pension, effectively amounting to 78.2% DA/DR for the purpose of fitment, and (ii) Modifying the liability of BSNL towards the payment of pensionary benefits to the retired employees.


The pension of BSNL pensioners/family pensioners, who retired prior to 10.06.2013 has been revised w.e.f. 01.01.2007 notionally with actual benefit w.e.f. 10.06.2013, by allowing the benefit of merger of 50% DA/DR with Basic Pay/ Pension, effectively amounting to 78.2% DA/DR for the purpose of fitment at par with the serving employees of BSNL. However, increase in the amount of DCRG, leave encashment and commutation of pension in respect of these pensioners shall not be increased on this account.

The pension liability in respect of employees of Department of Telecommunications (DOT) / Department of Telecom Services (DTS) / Department of Telecom Operations (DTO) who retired prior to 01.10.2000 is solely borne by Government of India and the BSNL will have no liability in respect of these employees. In respect of employees who are absorbed in BSNL, the liability on account of pensionary benefits shall be fully borne by Government while BSNL will continue to discharge pension liability by way of pension contribution in accordance with FR-116 for the period they so work/worked.

The revision entails an estimated recurring annual expenditure of approximately Rs 129.63 crore for pensioners and Rs 24.93 crore for family pensioners and arrears from 2013-14 would be Rs 239.92 crore approximately for pensioners and Rs 44.62 Crore approximately for family pensioners. Approximately118500 pensioners all over India will be benefitted by this revision.

This revision will fulfill the long pending demand of revision of pension of BSNL absorbed employees who retired prior to 10.06.2013 and will bring the pensioners at par with the serving employees of BSNL by removing the anomalies. It will help in reducing the financial burden of BSNL and removing prospects of industrial unrest in BSNL while fulfilling the commitment of Government.

Background:
The decision of the Cabinet has come in the wake of an anomalous situation created in the difference of pension formula among the BSNL retirees who retired before and after 10.06.2013. Further, the decision regarding pensionary liability is on persistent demand from various quarters and a series of deliberations at different levels to fulfill the assurance given by the Government before corporatization i.e. before formation of BSNL.

नई दिल्ली: सातवें वेतन आयोग (7वां पे कमिशन) की रिपोर्ट को कैबिनेट ने कुछ संसोधनों के साथ स्वीकार कर लिया और न्यूनतम वेतन में खास बढ़ोतरी नहीं होने का हवाला देकर कई कर्मचारी संगठनों ने अपने समर्थकों के साथ 11 जुलाई से हड़ताल पर जाने की घोषणा कर रखी है। करीब 33 लाख कर्मचारियों का समर्थन प्राप्त इन संगठनों ने सरकार को 6 जुलाई तक की अंतिम तारीख दी है जिसमें सरकार अपने निर्णय से इन्हें अवगत करा दे।


सरकार के निर्णय से असंतुष्ट रहने पर कर्मचारी संगठन अपने हड़ताल के फैसले पर आगे बढ़ने का निर्णय ले सकते हैं। फिलहाल बुधवार की स्थिति यह है कि 33 लाख कर्मचारियों की हड़ताल पर जाने की धमकी से दबाव में आई केंद्र सरकार की कर्मचारी नेताओं से बातचीत जारी है। लेकिन आज तक सरकार की ओर से कर्मचारी नेताओं को लिखित आश्वासन नहीं दिया गया।




मौखिक रूप से न्यूनतम वेतनमान बढ़ाने को तैयार सरकार
कर्मचारी नेताओं का कहना है कि सरकार ने मौखिक रूप से कह दिया है कि न्यूनतम वेतनमान बढ़ाने की उनकी मांग को मान लिया गया है। सरकार ने कर्मचारियों की मांग और वेतन बढ़ोतरी में कुछ विसंगतियों को दूर करने के लिए कमेटी बना दी है। यह कमेटी बैठक कर कर्मचारियों की दिक्कतों को दूर करने का प्रयास कर रही है।

सरकार ने नहीं दिया लिखित आश्वासन
कर्मचारी संगठनों के नेताओं का कहना है कि सरकार से बातचीत जारी है और उन्होंने फिर दोहराया कि सरकार लिखित आश्वासन दे या ऑशियल नोटिफिकेशन जारी करे जो सरकार ने अभी तक नहीं किया है। यानि अभी गतिरोध बरकरार है। सूत्र बता रहे हैं कि दोनों ओर से बर्फ कुछ पिघली है। सरकार जहां न्यूनतम वेतन बढ़ाने की कर्मचारी संगठनों की मांग पर राजी हो गई है वहीं, कर्मचारी संगठन भी कुछ झुकने को तैयार हैं।

न्यूनतम वेतनमान 22-23000 रुपये किया जा सकता है
सूत्र बता रहे हैं कि जहां कर्मचारी संगठन 7वें वेतन आयोग द्वाया तय न्यूनतम वेतन 18000 से बढ़ाकर 26000 करने की मांग कर रहे हैं वहीं, सरकार की ओर से इशारा किया गया है कि इसे 22-23000 रुपये किया जा सकता है। सूत्र बता रहे हैं कि सरकार की ओर से कर्मचारी संगठनों को बता दिया गया है कि कर्मचारियों की न्यूनतम वेतन मांग के अनुसार सरकार पर जो खर्चा आएगा वह काफी ज्यादा होगा, इसलिए कर्मचारी संगठनों को सरकार ने अपनी मजबूरी भी बता दी है। अब कर्मचारी संगठन इस पर विचार कर रहे हैं कि सरकार के इस प्रस्ताव को स्वीकार किया जाए या नहीं।

बढ़े वेतनमान को लागू करने पर सरकार पर पड़ेगा बोझ
सरकारी सूत्र बता रहे हैं कि यदि सरकार इस बढ़े वेतनमान को लागू करेगी तो सरकार यह भी अध्ययन कर रही है कि इसका अतिरिक्त बोझ कितना पढ़ेगा। सरकार इस नए वेतनमान का खर्च वहन करने की स्थिति में है या नहीं।

न्यूनतम सैलरी और पेंशन है कर्मचारियों की मांग में
कर्मचारी संगठन मानते हैं कि उनकी सबसे अहम मांग न्यूनतम सैलरी में बढ़ोतरी को लेकर है। लिहाजा इसे लेकर केंद्र के आखिरी फैसले पर सबकी नज़र रहेगी। पहले दौर की बातचीत में कर्मचारी संगठनों ने मुख्य तौर पर दो मांगे सरकार के सामने रखीं हैं। पहली, कर्मचारियों की न्यूनतम बेसिक सैलरी 7000 से बढ़ाकर 26000 सैलरी की जाए। दूसरी, नई पेंशन व्यवस्था को लेकर उनकी चिंताओं को दूर किया जाए।

7वें पे कमिशन में बिना बदलाव के सरकार पर बढ़ा 1,02,100 करोड़ रुपये का सालाना बोझ
सातवें वेतन आयोग द्वारा लगाए गए अनुमान के मुताबिक, वर्ष 2016-17 में इसकी सभी सिफारिशों पर अमल से अतिरिक्‍त वित्‍तीय बोझ 1,02,100 करोड़ रुपये का पड़ेगा। इसके अलावा वर्ष 2015-16 के दो महीनों के लिए वेतन एवं पेंशन से जुड़ी बकाया राशि के भुगतान हेतु 12,133 करोड़ रुपये का अतिरिक्‍त बोझ वहन करना पड़ेगा।

It is announced for general information that during the year 2016-17, accumulations at the credit of subscribers to the General Provident Fund and other similar funds shall carry interest at the rate of 8.1% (Eight point one per cent) w.e.f. 1st July, 2016 to 30th September, 2016. This rate will be in force w.e.f. 1st July, 2016. The funds concerned are:



1. The General Provident Fund (Central Services).
2. The Contributory Provident Fund (India).
3. The All India Services Provident Fund.
4. The State Railway Provident Fund.
5. The General Provident Fund (Defence Services).
6. The India Ordinance Department Provident Fund.

The National Joint Council of Action (NJCA) met at the Staff Side office, JCM, New Delhi today at 11:30 AM as scheduled. During the discussions, the Convener received an invitation from the Honourable Home Minister, Shri Rajnath Singh. The following members of the NJCA met the Home Minister in a delegation.

The issues in the Charter of demands were discussed with special reference to the 7th CPC related demands. The delegation brought to the notice of the Honourable Home Minister that the NJCA has not received a communication from the Government over the assurances held out on 30th June, 2016, when the NJCA delegation met the Honourable Home Minister, Finance Minister and the Railway Ministers. On 30th June 2016, the Government had assured to refer the revision of Minimum wage and fitment formula to a Committee. The Finance Minister has also clarified that the Government has taken the decision to implement the recommendation of the 7th CPC to bring about parity between the past and present pensioners.They added that such a communication in confirmation of the assurances will enable them to take a decision over the strike action which is to commence from 11th July, 2016.

The Honourable Home Minister assured the delegation that the Government will honour the assurances held out to the NJCA leaders on 30th June, 2016 and accordingly the Honourable Finance Minister, Shri Arun Jaitly will issue a Press Statement today, with copy to NJCA.

After receipt of the copy of the Press Communique issued by the Honourable Finance Minister, the NJCA will take a final decision.

Government assures Representatives of Unions representing employees of the Central Government that the issues raised by them relating to the pay scales and other recommendations of the 7th Pay Commission would be considered by a High Level Committee 



Representatives of Unions representing employees of the Central Government had met the Home Minister Shri Rajnath Singh, the Finance Minister Shri Arun Jaitley and the Minister for Railways Sh. Suresh Prabhu in the evening of 30th June, 2016. 

They had requested that certain issues raised by them in relation to the pay scales and other recommendations of the Pay Commission be allowed to be raised before a Committee of Secretaries looking into different aspects of grievances of employees in relation to the Pay Commission recommendations. 

The Ministers assured the Union leaders that the issues raised by them would be considered by a High Level Committee.

Accordingly, The NJCA has received the Press communiqué issued by the Honourable finance Minister today. The Committee set up to look into the matter of minimum wage and fitment formula is expected to submit their report to the Government in the given time frame of not more than four months. In view of these developments, the indefinite strike call which is to commence from 11th July, 2016 is deferred till the committee finalises its report.

Respected Sir,

1. The 2.57 fitment factor recommended by the 7th CPC and accepted by the Govt. is essentially a multiple factor which is the ratio of the new minimum pay arrived at by the 7th Pay Commission (18,000) and the existing minimum pay (7000)

(Para 5.2.7 of 7th CPC Report)

5.2.7 Fitment: The starting point of a Sepoy (and equivalent), the entry level personnel in the defence forces, has been fixed in the Defence Pay Matrix at ₹21,700. The starting point in the existing pay structure is ₹8,460 for a Sepoy/equivalent. The fitment in the new matrix is essentially a multiple factor of 2.57. This multiple is the ratio of the new minimum pay arrived at by the Commission (₹18,000) and the existing minimum pay (₹7,000). The fitment factor is being applied uniformly to all employees. It includes a factor of 2.25 to account for DA neutralisation, assuming that the rate of Dearness Allowance would be 125 percent at the time of implementation of the new pay as on 01.01.2016. The actual raise/fitment being  Report of the Seventh CPC recommended by the Commission is 14.29 percent. An identical fitment of 2.57 has also been applied to the existing rates of Military Service Pay (MSP), applicable to defence forces personnel only.

This provides only 14.29% rise in salary as well as in pension which is the historically lowest raise given by any govt in the past seventy years this has happened because of incorrect calculation of minimum revised salary resulted not only by adopting lower prices of commodities but also due to adoption of Aykroyd formula without updating it.

2. It is surprising as to how a gender biased formula of Dr Aykroyd adopted by ILC in 1957 is applied, without updating, in digital India of 2016. In today’s scenario how can Indian civil society accept a formula for minimum requirement including just 2700 fond calories for a family of four with moderate physical activities which treat the lady of the house as 0.8 compared to the adult mate of the house, further more so this formula does not at all take into consideration the minimum requirement of todays digital india i.e. smart mobile phone with an internet connection.

3. Considering wife to be .80 unit is nothing but gender bias indicating a colonial mindset of Dr. Arkroyd. In the present scenario a wife too puts in the same amount rather more of physical and intellectual work as compared to the husband she needs more nutrients & healthcare to keep herself fit to be a mother and as an educationist for her school going children. she needs more better clothing than 1957. A lady whether she is a wife of a labourer or of a secretary to govt. of India has a basic right to keep herself reasonably presentable for which she needs some minimum add-one. As such treating her to be less than a unit is gross injustice, gender bias and unconstitutional. Similarly growing children of less than 14 years need more of proteins, fats & carbohydrates, need to take sufficient exercise & field activities for healthy growth. Today they need much better and more clothing. better education & healthcare compared to 50s. The nation needs healthy & stout young citizens. It is against the National interest to restrict their need based minimum requirement to.6 unit.

4. Sir, in view of the facts enumerated in fore going paras. Minimum salary & consequently the fitment factor for both pensioners & employees need upwards revision. Bharat pensioners Samaj therefore appeal to you to revisit the issue to take a favourable decision.
